ILR for Outside born child

Post by dineshkumarvp » Thu Dec 22, 2016 9:39 am

Hi,
I have got my ILR recently. Could you please let me know, when my son will eligible for ILR?

-> My son born in India - outside UK and he has entered in UK as PBS dependant on Sep-2013.
-> My son visa extended on July-2016
-> My wife has entered as PBS dependant in Sep-2013 and she will be eligible for ILR on Sep-2018.

My question is that, can I apply for my son ILR now using SET-F application? (or) Do I need to wait till Sep-2018(till 5 year residency in uk)? Please confirm.

Thanks in Advance.

Thanks for quick response.
Once my wife get ILR,Can I go directly for British passport for my son based on both parents on ILR status? (or) Should I need to go ILR first and applying citizenship after a year?

Your son will require ILR. Only a British citizen can apply for a passport, your son is not British.

Also, if either parent is British or applying at the same time as the child, there is no need to wait 1 year on ILR.

Forget the concept of waiting for a year after ILR; that only applies to adults naturalising under section 6(1) of BNA - not to minors.

No, a foreign born child needs to be registered together with parents who are naturalising or else registered after they have naturalised.
Passport is a separate and final step after successful naturalisations/registration.
