What happens if I break up whilst on a Residence Card

Post by PeatD » Sat Dec 24, 2016 11:57 pm

I am currently allowed to reside in the UK on a residence card as the unmarried partner of an EU citizen, with both of us living and working full time in London. Although our relationship was durable when applying for the approval to stay, I am now in doubt and looks like we are on the verge of breaking up :(

I really want to stay in the UK, however I understand that this permit to stay is based on the fact that I (an Australian citizen, previously in the UK on a Tier 5 Working Holiday Visa) am in a "durable relationship" with an EU citizen. I was only granted the card in September, so am not even that far into the 5 year period I was approved for.

Please can anyone provide some advice, or direct me to the right (and most recent) thread on the topic? I could not find anything on the forum and am super concerned that I will most likely need to pack up my life and forfeit the career I've built for myself during my 2.5 years in London. Of course I don't want the relationship to continue just because of this either, but would just like to understand protocol and manage my expectations during this tough time :'(

Thank you in advance.

Yes, your understanding is correct, you will have no basis to remain in UK if relationship ends.
Your RC is not a 'visa'.
Suggest start work on a Plan B.

Do you have any UK born grandparents? If yes, then an Ancestry visa is a good route.

Otherwise you might want to explore a Tier 2 General Visa if you qualify.

Thanks everyone. So I take it the Tier 3 doesn't actually work anymore (just read that it's for unskilled migrants but never actually came into effect)? Unfortunately I don't have any UK ancestery - any other plan b suggestions? I am not university qualified nor do I have any specialist skills. Could I look into studying and perhaps some kind of student visa?

If you have no hope of Tier 1 or Tier 2 then Tier 4 is probably your last bet.

T4 costly for international students.
Good luck.
