hey guys, i am having a big problem that is twisting my head. hope u can help.
I am pakistani national and had a uk student visa, recently I applied for my HSMP visa, and for some reasons my HSMP visa has been rejected, and also Home Office cancel my current student visa, and they gave me 28 days to leave the country.
my girl friend is latvian national, and currently she is in Latvia. She used to work here in UK about a year ago, she is interesting to come back to uk and get married with me.
I don’t know what to do. As I cant married here, because I need COA to get married here.
And I cant go to Latvia, because I don’t have a Latvian visa.
Please help me what to do to stay with her in UK.
Desperately waiting reply from seniors members.

Why was the HSMP refused and why was the student visa curtailed?

now they find out that the college i used to study few years ago was a fake college. on the basis of that they refused my visa.

You will need to try the EEA route then.

Will he have time to apply for CoA, marry her and apply of EEA permit?

I can't see how he can it without travelling to Latvia unless he marries in Pakistan or third country?

thanks wanderer, he cant apply for COA, because to apply for COA, u have to have 3 month valid visa. to go pakistan and get married there is not a probelm, but very difficlut to get visa from there.

I think that's the only option, he can get a CoA - the three month thing has been abolished but in less than 28 days there's no way he'll get it in time.

Nor will he have time to get a Schengen to Latvia.

Only option is to return home and marry there.

Or, I wonder if he could reapply for a student visa in country and get section 3c cover, I dunno if that would get enough time tho....

Isn't your girlfriend/fiancee still in Latvia?? She's not in the UK yet - when is she planning on coming? The longer you delay things the more complicated it might become.

Plus, since she's on of the A8 nationals, I thought she has to go on the Workers Registration Scheme and have 3 months' bank statements before using the EEA route (or am I thinking of something else?)?

Yes she is in Latvia. She is planning to come back in April.
She already got Work Registration Scheme last year, and work here some times.
The main thing is that I don’t want to go back, and I can’t apply for a Schengen visa here, because my current visa is less then 28 days.

I can't see any option other than to go home and apply from there, there's no time to do anything else and if you overstay you're looking a being blacklisted.
