Need Advised for ILR(debt difficulty)

Post by HUDABATOOL » Sat Mar 26, 2016 3:06 pm

HI
I have to apply for ILR on the basis of long residency in FEBURARY 2017.but I have some credit card debts and I am facing difficulty to pay my minimum payments because my job has been finished.

Question : if I take debt management plan to pay my outstanding amount so will it affect my ILR Application and Citizenship Application?????
Note : this is not CCJ it will be DEBT MANAGEMENT PLAN ,I will pay a fix amount to the Debt management company and they will pay accordingly to my credit companies.

Thanks

No, it should have no effect either application as long as you stick to the payments and have no CCJs, IVA or bankruptcy.

I am on family visa, can i apply for ILR on the basis of LR?

Post by HUDABATOOL » Wed Apr 13, 2016 6:32 am

HI,
Please help me in my query regarding ILR (LR)

- I came in UK on 15 June 2005 and since than lived on my husband dependent visas (student/PSW/HSMP).
- Applied for ILR on the basis of Long Residency on 29 May 2015, got refused ILR in August 2015 because I was out of the UK for 9 months (from June 2006 to February 2007), But Home Office granted me 30 months visa on family basis because my husband and children are British National.

QUESTION:
Can I apply for ILR again on the basis of Long Residency as my 10 years will be completed in February 2017? (Period Claim: February 2007 to February 2017)

Note: Reason of asking this question is because one of my friend told me that I can't apply for ILR again in February 2017 because I am on 30 months family visa and I will have to stay on family visa for another 10 years than I will be eligible for ILR.

Please reply.

Thanks

I believe you will qualify for LR(LR) on such date in 2016 when your absence from the date you left UK (in 2006) and the date you returned to UK (in 2007) falls below 180, provided all other requirements are fulfilled.
e.g. - if you returned to UK on 17-Feb-2007, you will fulfill the "10 years continuous lawful residence requirement" (276A & 276B) on 22-Aug-2016.
Life isn't fair, but you can be!

Need help to apply for ILR on the basis of 10 years LR

Post by HUDABATOOL » Thu Jan 19, 2017 12:59 am

Hi,
I came in UK on 15th June 2005 and I applied for ILR (LR) on 25th May 2015 but HO refused my application on the ground of more absences because I was out of the UK from 10-06-2006 to 17-03-2007, But they asked me to pay £500 for IHS and when I paid that amount they issued me 30 months visa (Limited Leave to Remain) which will expire on 05-02-2018.

since the date (17-03-2007) when I returned to UK I was out from UK just for 45 days only.

Question:
Can I count my continue stay in UK from 17-03-2007 to 17-03-2017 and apply for ILR (LR) again? if it is possible than am I eligible to apply 28 days before completing 10 years which is 20-02-2017?
And can I go for premium service or should I send by postal service.

Waiting for your kind advise.

Thanks
