FLR(FP) need urgent advise please

Post by bdoli » Tue Jan 31, 2017 11:25 am

Hello everyone
Please have a look at below situation and assist
Myself: entered 2009 as student. Visa expired 2011 and overstayed. Indian.
Mother: recently got 5 year EEAFM. Indian.
Father passed away when I was 10.
Brother: applied for PR since he completed 5 year EEAFM & he's married to EEA national with PR. Indian.
My sister in law: EEA national with PR
My niece: currently applied for BC

My most recent application for EEA-EFM was refused because I failed to meet their requirements.
After speaking to 3 solicitors/barristers got different advices. One said reapply, one said JR and one said FLR-FP.
Last one seems sensible but would I tick all boxes if I go for Private life in UK (10 year route) or Leave outside the rules on the basis of family or private life

The most important point I want them to take in consideration is that my whole family is in UK and no family ties back home. Although in caseworker views I can go back and make new friends, I'd still be separated from family.
Not just the ones mentioned above, I've got uncle, aunt, their 2 children (all BC) and friends in here.

Please advise before home office takes any deportation actions.
Than you and I really appreciate your time and feedback.

Was your father the EEA national who died?

It appears you may have been advised wrongly by these 3 solicitors and barrister.

Not sure about this topic or who it is for as OP has previously posted that he/she is a Polish National and also that he/she is India with a EEA residence card :?:

Hi Cr001
You are right. This forum account belongs to the Polish EEA national. We live in the same household and I thought it wasnt sensible to make a new forum account under the same IP. I am the EEA national's sister-in-law.
Apologies for not making it clear while posting.

What proof of dependency on the EU citizen did you provide for the EEA FM application?

FLR(FP) is not an easy route to qualify for. You are young, single and have no children. HO will very likely take the view that you can return home.

Well they refused because I didn't join EEA national immediately after entering UK. There was atleast a year's gap before we were in the same household.
Secondly, EEA national and brother both work in same place and both salaries are paid in brother's account so they ignored that I was dependant on EEA national.
Lastly as mentioned earlier, although young at age all my family is in UK. So yes I can make friends in India but can't have a Family life over there. Plus the bond with my niece is no less than a mother daughter relation.
