Tier 2 General Visa Extension on Mar 2017

Hi,
One of My friend cousin who is in Tier 2 General Visa, having the below Query. Please find his query details.

1. Am currently in Tier 2 General Visa working with same company for last 2.5 years. who was paying £21,000 till December 2016. I got a hike now from end of Dec month(2016)Salary revised to (£26,000 - from Jan 2017 onwards). Am planning to apply Tier 2 extension visa with current company(Same code/NFQ code) on coming Mar last week 2017(with last 3 month hike Salary). Can I apply Tier 2 General extension on Mar end 2017?
Will there be any problem if apply Tier 2 extension in this way ? Any chances of rejection?

2. If I apply Tier 2 General extension with same company(same job code),Will I get same COS or New COS will be generated ?

Can someone help/guide in the right path.

No problem
Any chances of rejection?
Did your employer reported your pay rise to UKVI within 10 working days of effective date of pay rise? If yes, then all good, if not then it could be problem but very rare chances.

Also, check that 27K is appropriate experienced level salary for his SOC code according to the latest SOC salary list.
If I apply Tier 2 General extension with same company(same job code),Will I get same COS or New COS will be generated ?
your company will have to generate a new cos for you. You cannot use the old one as it had already been used for your last visa application.

Page 25 --- "There will be no transitional arrangements for applicants granted between 24
November 2016 and April 2017 - applicants who were required to meet the current minimum salary
of £25,000, will be required to meet the higher rate if they submit a Tier 2 application after April
2017".

1. So is it legally accepted of my salary hike which was done after End of Dec 2016 considering the above point)?

2. Will there any issue rejection mentioning to the above point ?

If he is applying for extension in March, then he should be fine with the 27K as long as this salary is at or above the minimum required for his SOC code.

If he applies after March, then he will need to have at least 29K pay.

What is his SOC code and working hours?

He is applying for extension on SOC Code 2139, Experienced: £27,000 -

Weekly - 37.5 Hours

But as mentioned earlier, his Company has hiked the salary up to £26 K Not 27K ?

Hi,

According to the latest code of practice document, Experienced pay for 2139 for 39 hours a week is 29,900 and not 27K. See link below:

for 37.5 hours a week, his pay needs to be prorate and he should be earning at least £28,750. His company will have to increase his salary to meet this threshold.

I have same question regarding this note:-
Please note: The Home Office has announced that the minimum salary of £25,000 will rise to
£30,000 in April 2017. There will be no transitional arrangements for applicants granted between 24
November 2016 and April 2017 - applicants who were required to meet the current minimum salary
of £25,000, will be required to meet the higher rate if they submit a Tier 2 application after April
2017.


One question
Does that mean that i do not need to earn an experienced rate salary if I apply for my TIER 2 (General) VISA an extention in April 2017? (My VISA expires in 14 July 2017)

Just wanted te be sure..

No, it means you will have to be on experienced rate or 30,000 (whichever higher) if you apply in or after April 2017.

I think I will apply for my extension in March then? But is it okay to apply more than 3 months earlier before the VISA expires? [VISA expires in 14 July 2017]

Just found i do not have COS allocation left. So there is no way that I can apply for my extension before April...Unless my salary is increased to 30,000.. :shock:
