Question for Tier 1 E 5 yr LTR.

As we all aware that HO took long in some cases. Wondering what will happen during such cases for ILR.

Easy Timeline for understanding:
Suppose a Team/ Individual Applied for Tier 1 E and got on : Jan 2013 with 3yrs validity
Visa Expire on : Jan 2016
Applied for VISA Extension : Dec 2015
Got VISA Extension : Jan 2017
VISA valid till : Jan 2019 (2 years)

Now question is
1) 5 yrs Lawful stay is completing on Jan 2018. But are they allowed to apply on Jan 2018 or they are suppose to wait till Jan 2019.

2) How the hired employee calculation will be in this case?
a) As extension process took a year, will employee’s hours in this period will be counted? ( in above example Jan 2016 to Jan 2017 Team was waiting for result)
b) Employee’s hours after Jan 2017 ie only after extension will be counted.

Yes, time spent on section 3C is counted towards lawful stay. Can apply in Jan 2018 if you meet ALL THE CONDITIONS OF ILR.

24 months of employment needs to be created AFTER extension is granted.

Please understand that HO will always issue a TWO YEAR visa for your extension regardless of how long you waited

i m just asking for my knowledge if extension process takes 2 years after 2 years they give visa for 2 years so u have to work another 2 years to meet job requirement criteria or the job requirement would be accepted while ur file was in process ?

This is just like a hard punishment.
First we are made to wait .. n then this.

As I said above employment created on section 3C does NOT count. Very rare that you have to wait tow years, the longest time waiting here has been 10 months so far. Under transitional arrangements you can hire 4 people for 6 months for example so only six extra months.
