Visitor Visa Enquiry

Post by Bammie » Wed Feb 15, 2017 8:16 am

Apologies in advance if this sounds complicated.

My husband and I (with our primary school aged son) are wanting to visit the UK and Europe for approx 1 year from July 2017 - July 218.

I have applied to study part time at one of the Uk's Universities. Because the course I am doing is part time I am not able to get a student visa. The course is over a number of weekends throughout an 8 month period - so does not require weekly contact.

We are wanting to base ourselves in the town where the university is (rent a house etc) to use as our base. We will travel to other cities and towns on weekends and for each of the long school holidays go to the continent. I expect we will leave the UK and return on at least 6-8 different occasions over the year.

As Australians we can get enter the UK for 6 months to travel for a holiday, with no issues. We do not need to work (my husband may possible get an EU Blue Card from a company he has been working with here but that is not determined yet), we will have a large sum of money available to us in our own bank account, that we will use to support ourselves for our adventure year.

My questions are the following:

1) Does the 6 months - reset each time we leave the UK?
2) How many trips back and forth can people make without being "stopped" and asked what they are coming for (other than the general why are you here questions)?
3) Can we enrol our son in a public school (we want him to experience a full life in between our travelling, and make friends and school is probably the best way to do this - also he cant miss a full year of schooling of some kind)?
4) Will there be any issues with the NHS for emergencies?? We expect to have to pay for general GP visits etc.
5) From what I can see there is no visa that allows us to stay in the UK for 12 months as tourists?
6) Do you know of any instances where people are refused re-entry (in the above type scenario) as we would need to collect our belongings left in our rental etc??? :/
7) Anything else you can think of that we haven't that might disrupt our plans??

Thanks in advance for info and suggestions.

1. No - fixed rule is 6 months validity in every 12.
2. If the IO suspects you are residing on a visit visa you will be bounced. Even staying the full six month validity is frowned upon.
3. Unlikely, not the action of a visitor, although I'm sure the school will take your money...
4. Emergencies ok, GP's and treatment chargeable at 150% of the cost
5. Correct.
6. Yes, search the forums here.
7. It's altogether a bad plan.

You will be unable to rent a property without a visa allowing you to reside in the UK. Landlords are required to do Right to Rent checks.

As a visitor, you do not have the right to reside.

Do you not have any UK born Grandparents?

No free NHS use. You will have to pay 150% of the cost of treatment for GP, medicines, etc. Emergency would be a stroke for example, but you can still be charged.

EU Blue Card won't help your husband in the UK.

6. That would not be UKVI/HO's problem, you will effectively be residing in the UK as a 'visitor' and this is not permitted. You will also be flagged on the system every time in the future if you try to enter the UK.

Why study part time? Why not study in Australia?
