Section 3 MN1

Hi,

Me and my wife are applying for Citizenship along with our under 18 children. Both kids were born abroad. My question is

Is form MN1 is right form?
Section 3.1 (page 11)says " Please say which parent is the one who is British Citizen by descent and whom this application is based"

Non of the parents are Citizen yet, how do i answer it?


My understanding is I can use MN1 form for kids while we(parents) are applying for citizenship at same time?

Yes, a separate form for each child.
Section 3.1 (page 11)says " Please say which parent is the one who is British Citizen by descent and whom this application is based"
Not relevant, leave blank. Please do read the MN1 guide carefully, this is clearly explained who is required to complete this.


Do the children hold ILR?

Yes all of us have ILR including children.
Can I really leave it blank?
Can you point in MN1 Guidance which explains my point

In the guidance notes, it specifically is titled Section 3, which is ONLY applicable for applications under section 3(2) or 3(5) of the nationality act and for children whose parents are British by descent, neither of which is applicable to your children who are applying under section 3(1).

Hi All

The MN1 guide states for Part 3 of the MN1 form that
"If the application is for a child born abroad, to parents who are British citizens by descent under section 3(2) or 3(5) you must complete this section, otherwise go straight to Section 4: Good Character."
so far so good, happy to leave part 3 of the form out however...

on the MN1 form itself within Part 3, there is a sub-heading

Parent who is an EEA national exercising EC Treaty rights.
which covers 3.13 - 3.15 of the MN1 form.

so my question is if I am applying under Section 3(1) of the Act - i.e. at discretion of Home Office - but I am an EEA national with a permanent residence certificate, must I complete 3.13 - 3.15 of the MN1 form or can I safely leave this out??

@mthom123: I had the exact same question - and I was told to skip section 3 altogether as it doesn't apply to cases like ours "section 3(1)" applications.

Section 3 in its entirety only applies to different categories of applicants, those applying under sections 3(2) and 3(5).

You are EU and the OP is not. OP is NOT required to complete section 3 but you are required to complete the relevant section you quote. Please start your own topic with your own circumstances.

@CR001: are you sure that as EU citizens we are required to complete section 3 of the MN1 form - if making a "section 3(1) registration at discretion" for children born outside of UK (even though we're all EU)?
