Entrepreneur extension (employee matter)

any one help me in this matter i have
1 employee 35 hrs 13 month
2 employee 24 hrs 13 months
3 employee 40 hrs 7 months
my question is
its cover two full time employment requirement?

Are you pre or post April 2014

I assume 35/wk for 13 months (I assumed the generic 4.25wks/m)

You need to calculate for max 30/week (so those extra 5 or 10 hours are not counted)

from my calculation if you are pre APR 6, 2014 you are OK. if Post you are not

i got my Entrepreneur june 2014 going for ext jun this i have three months so can i do for this?

Wow, that is a very good catch Zimba! A nuance others would not notice..... (I always assumed 'enter' the route not apply to the route....) Hope HO sees it that way as up till know everyone was transitional, no precedents...

If so you are not transitional so you need two FT jobs for 12 months each. You have one with the 13 months. You have another for 7 months but till end June it is 4 months more so not enough (you need to now look at exact dates etc)

Your part time job does not add here.

The guide says:
Transitional arrangements
If you successfully applied to enter the route before 6 April 2014, and you are making an extension application or a 5 year settlement application, you may continue to employ .....
So anyone who applied before 6 April 2014 and then was granted Tier 1E visa successfully is considered under PRE April 2014 transitional arrangemnets.

In your case you are POST 2014 and transitional arrangements do NOT apply to you.
Unfortunately you do not seem to have created two separate full time positions. You cannot combine employee 2 and 3 unless BOTH positions existed for at least 12 months each.

I am being creative here to help you. Did the 7 month employee replace the 13 month employee? if so (maybe) that extra month could be rolled in the 7 month person role (you do not need the same person to do a job) and s/he has 4 months to go to end june.

you need to be precise how much time you are missing, if it is short there are options to file another visa and vary to extensions (HO does not like this but it is done and technically legal)

The guidelines in your case is "You need to create 2 jobs which exist for 12 months."
