I am helping a friend who came to the UK on a spouse visa but has recently separated. He is applying for permission to stay as the father of a British child. I have a few questions and would be very grateful for any help. Thank you.
Question 5.4 Where it asks if anyone else lives with him does he say yes as his son stays twice a week or no?
Q 5.7 It asks if his partner is working. Is this relevant as they're not together anymore?
Q 5.9 Does he need to detail any public funds his ex is claiming also?

He is applying on the 5 year route. I believe he needs to show adequate maintenance and housing. Is it sufficient that he has entered his salary on the application and the rent he pays on his property or should he include the workings used in applications for adequately maintaining himself and his son as per the current income support rates? Even though his son lives mostly with his mother?
Lastly, he has a current rental contract on a one bedroomed flat, which has a living room/Spam also. Does he need to get a property inspection report or will his contract be sufficient?

I forgot to ask, does he need to provide correspondence to his home address or is that just for partners proving they have a subsisting relationship?

Im hoping someone can help me with this. My friend is applying to remain in the UK as the father of a British child. He has recently split from his wife and she is refusing to let him have their son's passport. Will a certified copy be acceptable? He is really worried this will jeopardise his application. Yes, he has a full birth certificate with both parents names on. But his ex is reluctant to hand over their son's passport.

Birth cert and certified copy of passport with an explanation should be ok.

He will also have to include evidence of partaking in the child's life, any court orders re visitation etc.

Thank you for replying. Could you possibly take a look at my other post asking questions about the FLR (FP) application? If you've seen it already then I apologise. It's just that I have been able to help with most if the form but it is unclear on some aspects. I've phoned the government helpline and a number of advisers but no-one seems certain of the answers. The FLR(FP) guidance states that an applicant must provide either a passport or National Identity Card for the purpose of proving their nationality. If an applicant has a current passport does he have to send it or can he send his National Identity card instead? Or is the option of identity card only for those without a current passport?

What nationality is he? If he is a non-EU citizen, he has to submit his passport.

Can an applicant request that correspondence, particularly son's passport, be returned to a different address, i.e. his ex-wife's address?

If applicant is for a father of a British child who is no longer with his wife, is it necessary to answer questions about his ex's finances. I.e. Question 5.7 of FLR (FP) asked about the salary of partner, but there is no scope to say that question is not applicable. 5.9 asks about public funds, which are only being claimed by the ex partner. Do we leave this blank or is this information needed?

The only thing we're struggling with now is a letter addressed to his son at his home he shares with his mum. She doesn't have any letters and it's a bit late now to get one from anywhere. Is this really so important to prove that the child lives with his mum? And is a birth certificate with both parents' names on enough to prove parental responsibility?
