Urgent Advice Please..Tier 2 to ILR wrong pay details....

Hello Senior members & Guru's

I have my premium service centre ILR appointment on 27th March. I booked it 2 weeks ago.

I am on Tier 2 to ILR 5 yrs route - No issues in my previous appointments.

Tier 2 from 29th Jan 2012 to 29th Jan 2018
So qualified for ILR on 29th Jan 2017

My pay was updated from 1st March 2017 for 35K

My problem is I have a my payslip showing my old pay 32K which was revised to 35K from 1st March 2017 in line with 35K.

The error happened due to HR forgot to send the updated pay details to the corresponding department in time, so now the old pay is paid and since the pay slip is printed by an outsourced company elsewhere, now I have received the pay slip with wrong salary, the wrong pay in the bank yesterday.

But my HR has realized the issue and now says it will be paid as arrears in April-17.

So my question is Can I still go for the premium appointment? with all the documents explaining the issue like as below.

1. Pay slips with old pay details and bank statement showing the old pay

2.Employment letter with the current relevant information and the confirmation of the current pay and the SOC code and the job needed for the foreseeable future.

3. HR Cover letter with an explanation of the situation regarding the wrongly paid issue for March 17.

and all other required evidence documents which are ready and correct.

Now I am thinking whether I am taking a risk in attending the appointment to get the refusal based on wrong payslip showing lesser than required pay?


Please help with advice...
As I have to make a decision by today....

Was your salary only increased in order to meet the requirement for ILR??

Hello CR001,

Yes my salary was revised for the ILR visa requirement and that will be my salary here after until I am due for an salary revision every year.

Expect this to be scrutinised heavily as it will show up like a beacon to HO (who are aware of this practice to meet ILR requirements) and possibly delays in your ILR application and potential questions for your sponsor.

But as it stands now, you don't have proof of your earnings for ILR in the form of a payslip.

That is what I think, but My employer HR thinks, they are paying you in line with the current requirements of the SOC code document dated 6 April 2015 Version 04/15

Like every year March we receive a pay rise based on so many reasons.

so in 2015 march I received the pay rise for that year from 2014 and so my pay was increased in march 2016 & march 2017 in general which seemed to come in handy for my ILR.

But my HR has forgotten to update the SAP system on a particular date which resulted in this issue.

I told my MR that this will create a doubt, my my HR is hopeful that it will not be an issue.

So was your increase in 2016 also about 10%??

pay from 2012 where i got my Tier 2.

Jan 2012 - Tier 2 from PSW - 26K - new entrant 20K
March 2013 - 27K
November 2014 - 31K - went for Tier 2 extension in November - 30900 for experienced in version 4/14
March 2015 - No pay hike
March 2016 - 32K
March 2017 - 35K - in line for ILR

This is how my pay has been progressive.

During my tier 2 extension in Nov 2014, i had the same issue but the case worker did not question me as i submitted the letter from employer saying the pay has been into effect from Nov-14

which was accepted then.

But i feel I am presenting my ILR with incompleteness this time as it is my final application with UKVI .

Tier 2 expiers on 29th Jan 2018 had extension for 3 years and first Tier 2 for 3 years.

I have been to the PEO appointment now and they did not ask any questions regarding this.

But I submitted the letter from employer regarding the manual error as well.

I have got ILR now.

Congratulations... Phew.. stressful scenario but positive outcome in the end. I would have postponed the appointment for a couple of months to get all docs, but hey lucky you :)
My advice is based on personal research/experience, so pls check relevant UKVI sources.
