Confused with the category to apply

Hello Admin,
Please could senior member advise me.
My Current Scenario:
My present wife is currently on a five year parent visa route (as she is a mother of British Child but was NOT married to the child's father - but on the visa for 3 years now).

I am currently on a student visa which expires next year and my wife currently earns above 23k per year (we have been married for 6 months now). We live together (myself, my wife and her son). As she is on a parent visa route, (is she classed as a settled person?) please could you advise
1. Which category to apply for?
2. Which form to fill?

You answered your own question, She holds a visa so no, she is not settled.
