Tier 2 General Visa extension Salary requirement

Post by pm2904 » Tue Jan 10, 2017 10:08 am

Hi all,

Please I need some advice:

I am due to extend my current tier 2 visa in June 2017. I am working as a web developer (SOC 2137) and my current salary is £26000 (37.5 working hours).

The home office recently announced that the minimum salary of £25,000 will rise to £30,000 in April 2017.

I have read on the guidance for sponsors document that "the Applicants who were initially granted leave
to enter or remain with a CoS assigned before 24 November 2016 will continue to be subject to the £20,800 threshold, but there will be no transitional arrangement for those initially granted leave with a CoS assigned between 24 November 2016 and 6 April 2017 – they will be subject to the £30,000 threshold if they apply for extensions using CoS assigned from 6 April 2017".

If I apply for my extension in June, do I need to be on £30000 or I should be fine with my current salary?

Thanks

Many Thanks

Based on what you posted from guidance, you fall under the old threshold (but that's my interpretation of that text)
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Hi,

I am in a similar situation but I can say from the New policy guidance (page 25) published in April 2017 that if you are extending, the new salary rules don't apply to you. See statement below:

"If you are applying for an extension or a change of employment application and your initial grant of leave was granted on the basis of a CoS assigned before 24 November 2016
£20,800 or the appropriate rate for the job, whichever is the higher"

However, where I am having some trouble is knowing which "shortage occupation list" to use. For example, the PDF version on the Gov.uk site (which I used for my initial application) states for physical sciences 2113, experienced worker is £27,200. Whereas on the immigrations rules published 7th April 2017, it says £28,000

Hi @pm2904 @ikmanjuve

Can you please let us know that whether you have applied for the extension under old rules and have successfully got your visa?
I hope you were successful.
You could help me and all others in clearing things up which are not very clear.

Thanks
Lokesh
