Post by kumar114 » Tue Apr 11, 2017 10:13 am

Hi,
I have been recently just granted Tier 2 General VISA extension
Now I am planning to bring my wife here in UK.

1. Can I apply from here for my wife?
2. What documents are required from her side?
3. Do i need to sent photographs and chat logs and all that? (I was told it is only required If I was under ILR). Can someone confirm please?
4. Is this correct that (regarding maintenace)If I get a letter from my employer(A rated) stating that they will cover my wife's mainatenace for a month if she needs, I do not need to provide my bank statement nad payslips?
5. Is TB test required?
6. Do I need Tennancy Agreement and No Objection letter from Land lord?

Kind Regards
Kumar

1. Can I apply from here for my wife? Yes

2. What documents are required from her side? Read the guidance notes and search the forum, asked many times.

3. Do i need to sent photographs and chat logs and all that? (I was told it is only required If I was under ILR). Can someone confirm please? Yes you need to submit evidence of subsisting relationship.

4. Is this correct that (regarding maintenace)If I get a letter from my employer(A rated) stating that they will cover my wife's mainatenace for a month if she needs, I do not need to provide my bank statement nad payslips? Correct

5. Is TB test required? Yes but also depends where she is applying from.

6. Do I need Tennancy Agreement and No Objection letter from Land lord? Yes. If you stay in a house share with other people, you will also need a property inspection report to prove the property won't be overcrowded.

No it is not only for when you are on ILR. You have to prove subsisting marriage. Have a search, many refusal due to PBS dependents NOT submitting this or not submitting sufficient evidence.

A tenancy agreement is a standard contract issued under the Housing Act. It is not just anything put together. Your landlord will know what it should look like. Google AST or Assured Shorthold Tenancy.

Actually I live with my uncle and aunt. They do not own that place. But the flat is on their names and they just transfer money monthly into landlord account. How do i deal in such situation?

You will need to send a copy of their tenancy agreement, letter from their landlord giving you and your wife permission to live there and a letter from your family who you live with plus a copy of their council tax/utility bills in their name.

How big is the property??

Thanks CR001.
There are 2 flats. A and B. We live in flat A. Just 2 rooms.
Is it too small to live in 4 people? :(

Who is 'we'? You, uncle and aunt?

What do you mean '2 rooms'? How many bedrooms, does it have a lounge, Spam and bathroom??

Thanks for the link CR001.
Should not be a problem I guess although it says 2 rooms - 3 persons. I do not have any other option..i have to go with that.

Well exactly, the property will be overcrowded as only a 1 bedroom flat, which should only accommodate 3 adults.

Is there a high chance of VISa being rejected?

one bedroom will be overcrowded if you, your wife, your uncle and your aunt were to be living there. By your aunt, I assume you mean your uncle's wife. A few more questions for you;
1. Did your uncle inform the council that you are living with him?
2. is your uncle's landlord aware?
3.Does the flat have HMO certificate? bringing your wife to join you in a one bedroom flat already occupied by your uncle and aunt might trigger HMO requirement. And I doubt if any inspector will grant HMO certificate to a 1 bedroom flat for 4 people.

I also doubt if any UKVI case worker will be convinced that you can take care of yourself and your wife with such an arrangement.

I will advise you rent a flat of your own before bringing your wife in.

All these are my personal opinions.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

CR001- I thought tenancy agreement wasn't a required document for a Tier 2 Dependent visa (assuming that's what the OP is applying for his wife, and not Tier 2 general as the topic states) unless children are involved?

Your wife is the APPLICANT, even if you are completely the form.

Yes you can state a date no more than 3 months in the future. HO might not issue the 30 day visa in line with this though

If you state a date of intended travel as 1st July (for example) and you apply now and visa is issued on 22nd May (for example), HO might make the 30 day visa valid from 22nd May and NOT 1st July. It happens often that the 'intended date of travel' is ignored.

Hi,
One quick question..
I am brining my wife over here in UK.
When i logged in to the online application form, i see this 2 option
1. Please select Apply For Myself to start your visa application.
2. If you are applying on behalf of some one else please select Apply For Someone Else

Which one am i suppose to select?
Can I select 'Apply For Myself' and fill the form to make it look like my wife is filling the form?

kind regards
kumar
