Consent order breach

Post by estirichy » Mon Mar 27, 2017 8:18 pm

Hi guys

Has anyone experienced a consent order breach by the home office before and if so what action did you take?
Home office steated to reconsider my wife's case within 3months of sealing the order, but I know they are going to fail as time left is very little and we haven't heard from them since sealing the consent order.

I plan to send tsol an urgent reminder and also inform the court if the deadline pass, is this a correct approach?

Thanks u all for ur help

The consent order they normally issue, is usually worded like this:

"Absent any exceptional circumstances" the respondent will within 3 months of the sealing of this consent order make a decision.

I hope that clause is not on it?

Hi obie,

That's what is on the order, "absent special circumstances "
I didn't realise it was of much significance, could u shed some light on it please?

Thanks
