Hello

A husband arrived to uk on 2.5 year spouse visa which is about to expire. Since arrival the husband has been working earning less than 18,600. The wife does not work, they have two British children and are claiming tax credits.

Is it possible for them to apply for extension on the basis of being a parent via the 10 year route as they don't meet the 18,600 requirement

No, not the parent route. It will be refused. The parent route is for couples that are divorced/separated and share responsibility for kids but DO NOT live together.

FLR(FP) partner 10 year route is the one to go for if they do not meet the financial requirement.

I've been looking into this application. What is defined as 'insomountable circumstances' in the context of this application type. Trying to establish how likely it is to be refused.
