Hi,
I have applied my tier 1 Entreprenuer extension on 24 March 2017. Haven't received acknowledgement or biometric letter yet. How long does it take now a days?

I will be completing my 10 years on 6 July 2017. Can I apply
apply 28 days before completing my 10 years?

If I don't get the decision for my tier 1 application then I would like to vary my application. Can I vary my application at premium service?
If yes how this process works? Do I need to fill an application form (Set LR), book an appointment at premium service, send the letter to transfer my documents at premium service as all my passports are with home office.

how much fees do I have to pay?

I have already paid £1204 fee plus £600 health Surcharge.

Any reply would be appreciated.

Yes you can vary to ILR at a PSC. Book an appointment online and pay the relevant fees. Show up on your appointment day with the letter of intent to vary at the PSC. Your can request the refunds for your Tier 1E applications and IHS afterwards. You probably will not get a same day decision

There is no such covering letter. Write one yourself, describe your situation, put all the references on it and submit with SET(LR) form on the day.

Hi Zimba88,

I have received my acknowledgement letter on 28th April 2017. I will be completing my 10 years on 6th July 2017 but i will be eligible to apply 28 before completing 10 years, this mean earliest i can book an appointment at premium service for 9th June 2017.
My question is if i don't receive my tier 1 entrepreneur extension decision say by 1st June 2017 and i write to the tier 1 entrepreneur team to transfer my documents as i will be qualifying for ILR and i have booked my appointment on 9th June 2017. will they consider my time as legal stay in the UK as i will be asking them to transfer my documents at premium service? they can always put an objection that i stopped them to process my application??

I am not sure that is possible to be honest. Your documents must be requested by the case worker at the PSC to be sent there, after the case worker has accepted the variation of your application to SET(LR).
The other solution is to vary your application via post when you are eligible for ILR and then request upgrade to premium later. (See also: Premium Upgrade Closed ?)

I will complete my 10 years on 6th July 2017, my tier 1 entrepreneur extension application is already with the home office, Can i vary my application for ILR LR before 28 days completing my 10 years or do have to wait to complete my 10 years?

Hi Zimba88,

I have spoken to 2 solicitors today, 1 of them advise me that if you have valid visa for 10 years then you can vary 28 days early if you don't have valid visa for 10 years and your extension application is with home office then you can't apply 28 days and the other one said that you can still vary your application 28 days early.

Time spent on section 3C is COUNTED towards the 10 year lawful stay. You can vary 28 days before your 10 years is up on section 3C.
However if you do NOT have section 3C (for example you applied for a fresh extension application after a refusal) then you MUST wait for your extension to be granted first before applying for ILR.

Hi Zimba88,

I will be eligible to apply ILR LR on 9th June (28 days before completing 10 years) and going for the Tier 1 extension biometrics tomorrow to the post office, my question is just in case i get refused within this time period, can i go for judicial review and if yes will this time consider as a legal stay in the UK and it will not break my 10 years continues period?

JR has nothing to do with immigration rules and time spent pursuing it is NOT relevant at all.
Your section 3C ends after your AR concluded with a refusal (if you apply for it) and then you will be an overstayer from that point onwards.

Hi Zimba88,

I received the letter for biometric dated 26th April to enrol the biometric with 15 working days and i have given biometric on 15th May.

I have received the letter today dated 15th May that you have failed to comply with this instruction without providing reasonable explanation and now you have 10 working days to provide the biometrics.

Do i need to provide the biometrics again?

You mean July 2007 ?? It is 28 days before your 10 years is complete (from the date of entry).

Sorry yes its 6th July 2007 when I entered the UK. Can you let me know if i apply 28 days before completing the 10 years. Whats my eligibility date? ( 8th June 2017 or 9th June 2017 )

To vary an application for long residence, do I just need to complete SET LR application form and need to take supporting documents at premium service centre with cover letter to explain them that i am varying application?
