TIER-2 Change of Employer

Dear Immigration Experts,

Could you please provide your kindly advice on my below concerns regarding TIER-2 Change of employer.
I am currently working under a sponsor company under Job code 2139 since from last 7 months. And also my current leave to remain visa was granted till Dec 2018 on this Job code.
Recently, I have been interviewed and about to get an offer from another employer under job code 2126 for which RLMT was not required.

Here:
1. If just in case my new application with new employer got rejected for any reason, then can I continue with my old employer under same job as usual with previously granted leave to remain visa.! Do my previous grant leave to remain (Valid till Dec 2018) will get reset if my new application with new employer was not successful? Please clarify.

2. My current role falls under job code 2139 and now with my additional skills I have be qualified for a new role from new employer which was offering under Job code -2126. So will that be ok if I could change my job code from 2139 to 2126 duirng my new application?

3. Can you please re-confirm that, job code 2126 really not required RLMT.!

What is SOC 2126 and 2139 or are you expecting us to look it up? Is it shortage occupation or not?

Yes, Both the SOC codes

2139 - Information technology and communications professionals not elsewhere classified
2126 - Design and development engineers

Were listed under United Kingdom Shortage Occupation List, Table.

On first glance, 2139 and 2126 seem to be very different. 2139 is an ICT SOC while 2126 seems to be design engineer positions in electrical and electronics industry.

If you are confident of your skilllset being fit for both positions, then go ahead and apply, but keep in mind there will be additional scrutiny of because it's a SoC on the shortage occupation list

Also not all 2139 positions qualify as shortage occupation. It's only cyber security specialists for employers who fulfil the qualifying company criteria

Just a quick one again., Sorry

Say for suppose If I submit my application for change of employer with new Soc 2126, and due to any reason if my application get rejected by home office. Then can I still continue my employment with my existing employer as my current leave to remain was valid till Dec 2018.

Please kindly clarify how my existing visa validity could get effect if the latest application with soc 2126 get rejected.

Based on your advise I would deside whether to accept the new offer with soc 2126 or not. Because I dont want to slip or lost my existing visa validity if my new application get fail due to any reason

Kindly Advise

Even if your new leave application gets rejected , there is no impact on existing leave. You can continue to work for your current employer without any issues.

For your kindly response.

So what I understood is, If I can able to manage my existing employer not to withdraw my present Cos untill my latest application get sucessfull with new employer. If I received new BRP for new application sucessfully then will serve the notice period for existing employer and will move to new employer.

Else if my new application was un sucessfull then will ignore my new offer and will continue in the same role with my exisitng employer with my previously granted leave to remain.

Please correct if my understanding in not correct.
