Tier 2 (General - changes of employment - ISC exempt)

Post by balasugu » Thu May 18, 2017 9:38 pm

Hi,

I am an electrical engineer (2123). I came to the UK in 2015. Now, I found a new employer who has provided me with a CoS.
My CoS says,
Tier and Category: "Tier 2 (General - changes of employment - ISC exempt)"

Is the new employer exempted from paying ISC - Immigration Skills Charge ("ISC exempt") for me?

ISC exemption generally applies for PhD candidates and graduate trainee roles (which I am not) as per
Source:

However, if we dive deep into the government notification, as per
Source: http://www.legislation.gov.uk/ukdsi/201 ... 663#f00004
"Transitional provision
7.  A sponsor is not subject to the obligation to pay the charge where—
(a) the sponsor assigns a certificate of sponsorship to a skilled worker who was assigned a previous certificate of sponsorship as a skilled worker before these Regulations came into force;"
Am I correct to assume that my new employer need not pay ISC for me and so the option "Tier 2 (General - changes of employment - ISC exempt)" is correct?

I request the experts and those who have gone through this route and have successfully completed the VISA application process to please share their view.

Regards and thanks in advance,
bala

Only applications for new visas after 6th April 2015 are subject to Immigration Skills Charge. It's not applicable to you
