Hi,
I am a new member here and I have couple of questions.

1) My wife came to UK on 2011 as on Tier 1 General category' and Now she is British citizen.
I applied dependent visa in 2013. in 2015 again I applied extension on same category because at that time my wife don’t have ILR or Citizenship. And I got extension until March 2018. In meanwhile my wife got citizenship last year. So should I apply as 'Dependent of Tier 1' or 'Dependent of a British Citizen' for my extension?

2) Is there any template for cover letter in the forum that I can get and customise for my application?

1. Tier 1 dependent but only if she got ILR based on 5 years residence tier1 and NOT 10 years long residence.

2. No there is no template.

Thanks for quick reply. For little more clarrification .
Can i applly as a dependent visa under bitish citizen catageroy instead of tier 1.
Because in this i have to pay less fee

Yes but it will rest your clock towards ILR to zero and a new 5 year (2 X 2.5 year visas) before applying for ILR.

Actualy i spent 5 months instead of 6 month s in last year so
So thats why my clock has already set on zero. So this the reason why i wanna change my visa category .many thx

There is NO absence limit for PBS Dependents and your continuity of residence is not broken.

Hi,

My wife came to UK in 2011 on Tier 1 General Visa, obtained ILR through 5 year continuous stay and last year she got British passport.
I applied dependent visa in 2013. After this I again applied for extension in 2015 and got extension until March 2018.
As I did not meet the condition of continuous 5 years rule. Because in last year I spent just 5 months instead of 6 months in whole year. So I suppose my continuous period set to zero.

1)So Now should I apply as 'Dependant of Tier 1' or 'Dependant of a British Citizen' for my extension?
2) And how can I apply.

Why are you asking the question again????

THERE IS NO ABSENCE LIMIT OR RESTRICTION FOR PBS DEPENDENTS. Your absence has NO affect on your future ILR application as a PBS dependent.

Absence limit is ONLY applicable to Tier 1 or Tier 2 MAIN VISA HOLDERS.

actually on Gov.co.uk i didnot read any clear statement that dependent of TIER 1 should stay at least 180 in a whole year. but i just read that dependent should stay 5 years. so if there is any statement please send me the link and please also send me your phone number so that i can discuss my case more clearly.

There is no statement on absence because there is no absence limit. Some PBS Dependent ladies got to home country for 1 year maternity and still get ILR.

You are either overthinking this OR trying to justify to yourself to apply for FLR(M).

I enter uk on 23/04. 2013 and i have visa until 27/03/2018. so still i have one month less than five years . so what you suggest
should i have to apply ILR or
the Extention first and then ILR

Extend by post and then vary to ILR.

Or apply for ILR by post on the day before or the last date of your visa as you can apply 28 days before you reach 5 years residence.

Many thax for your eeply as we discussed in 2nd last post about extention and ILR. Soi need little more clarification .
Extend the visa by post and then at last day day of my current visa date i have to submit the application for ILR. is that right

Looking at the 'time and date' link I have provided, you could apply by post or in person for ILR on the last or second to last date of your visa validity as this is within the 28 days before reaching 5 years residence.

Why would you want to do that? You cannot make two applications to two different departments at the same time. If you want to apply for an extension and pay the visa fee and IHS of £600 for a 3 year visa, go ahead. ILR is already very expensive, even more so if applying in person.

If you have 5 years residence minus 28 days on the date your visa expires (or the day before expiry), you can apply for ILR. There is no requirement to have x amount of visa validity.

Why would they refuse it?

You can apply for an extension in person if you wish and then wait a couple of months and apply for ILR and pay again. You won't get a refund of any extension fees or IHS paid.

As mentioned, you don't qualify for ILR yet. You will only qualify in 2018 from the date you entered the UK.

But you will need English B2, Life in the UK test and cohabitation documents and partners evidence of ILR etc.

Read the guidance notes.
