What happens next after a successful appeal?

Post by gollywood » Mon Mar 03, 2008 9:45 pm

Hi - just found out that we were successful in our appeal for a Visitor visa for a relative from Pakistan to UK.

There is a thread on how I took on the Home Office an won here:-

http://www.immigrationboards.com/viewtopic.php?t=23643

The judge verbally said 'Your appeal is succesful. The Visit Visa is allowed'

Just some follow up questions.....

1) Does someone write to us to confirm us of this?
2) What does my relative have to do next in Pakistan - do they just turn up to the High Commission with their passport etc?
3) Its a visit - less than 6 months - do they need to get any health certificates to enter the UK?
4) The files I submitted to the AIT Court contained some of my Original documents (Payslips/Solicitor letters for my house/Bank Statements etc etc etc.

Will I get them back - should I contact them?

Thanks

1) AIT will send you letter called(appeal determination) within 2 weeks of court hearing to say that your appeal is allowed. They will also forward a copy of it to the Embassy Abroad. If the embassy/HOme office wants to appeal against this decision then they have 28 days to do so.

2)Nothing I think! they will be contacted by the embassy(in 2 months from now i think) to submitt their passports at local gerry's office. They may also want to you to confirm Intended date of travel.

3) I think NO! but not sure

Hello,

1. Wait for a determination.

2. If successful, wait for another couple of weeks and chase the AIT. If no objection from the Home Office was received, send a copy of the determination to the Embassy/High Commission.

3. Chase the HOPO and ask him to forward a copy to the UK Visas.

4. Chase the UK Visas and ask them to send a copy of teh determination to the Embassy (the Embassy will only "believe" a correspondence from the official source).

Normally that should result in a visa being issued in 3-4 weeks.

At least I do that in cases of my clients.

Hope you succeed.

Great advice.

So we wait for the 'determination'. Appeal was successful on 3 March.

Do you guys think they will be in a position to travel by June 08?

I think you sould send your passport to home office with a copy of appeal letter and your case ref.no.Then you will get passport back with visa stamp.
