Differences in start dates in HMRC records - Tier2(G) to ILR

Post by kUMARI16 » Tue Jul 25, 2017 11:03 am

Hi Experts,

Good morning and firstly many thanks for your valuable support you have been providing.

I have a query on my employment history held in HMRC records. Could someone please able to answer my query. Many Thanks in advance.

1. Initially, I received my Tier 2 General visa in 2012 with BRP start date as 19/07/2012 from company B but in HMRC records my start date in Company B showing as from 02/01/2013 and end date as 30/04/2014, also I can see my previous employer Company A end date showing as 05/04/2014 with £0 Pay in HMRC records(I was on PSW visa when I am working in Company A). Is this be a problem while I am applying for my ILR?

2. I have changed my employer from Company B to Company C on same Tier 2 General category in 2014 and received BRP under Company C with start date as 13/06/2014 but in HMRC records, my start date in Company C showing as from 01/07/2014 and Company B end date showing as 30/04/2014 (where I can see more than 60 days gap). Could someone please tell me whether this will be a problem while I am going for my ILR?

Please suggest me your thoughts...Many Thanks in advance.

as long as the hmrc records show the correct amount paid to u by company b in that year, i dont see it as a problem.
Real time paye rules were not enforced back then, and it may well be that the payroll took time to record that with hmrc.
no problem with the other issue of employer a, as that is common. they would not have issued u p45 on time, hence showing the continuing of employment.

Hi iworker,

Many Thanks for responding to my query.

Could you please answer to my second question which I raised specifically regarding the 60 days gap in HMRC records while moving from Company B to Company C? Is this a problem for ILR?

Also coming to the amount I got paid in total for the past 5 years are below for my COS given for £35500 per annum.
Tax Year - 2017 - £35500
Tax Year - 2016 - £35503
Tax Year - 2015 - £35499
Tax Year - 2014 - £35499
Tax Year - 2013 - £8874 from Company B (For three months starting from January 2013 as per HMRC) and £9641 from Company A (with end date as 25/05/2012 as per HMRC).

I am a bit worried about the tax year 2013 where my BRP start date on Company B showing as 19/07/2012 but in HMRC start date showing as 02/01/2013. Now what date I should consider for my ILR 5 year eligibility? Also could you please clarify whether that is a problem or not when I go for ILR?

Thank you for your time.

is company b the first one where u started working?
Company a never sponsored u for tier 2?
If so, i think u may well be fine, as sometimes it can take a bit longer to start the work, but it should be notified in the sms by the employer.
have u got p60 from this employer b for that year?
how about u contact the employer and ask them why the earlier months are not shown and hence taxes not paid.

In addition, could you please answer the below query?
