Baby just Born on same time of Parents getting ILR

Post by Jana2011 » Sun Aug 06, 2017 3:17 pm

Dear All,
Im new member in immigration boards.com and I was checking almost all topics related to my issue but no specific answer! I'd be appreciated to find a reply here please:

I was pregnant when I submitted my ILR form on 21/02/2017 for me and my family
we did biometric on 14/03/2017 and wait Home Office response..
My new baby girl born on 24/07/2017 === not registered until the moment as waiting for docs back ==
A letter received dated 04/08/2017 saying that our ILR application has been Succesfully APPROVED
and the BRPs will be sent in a period of 7 days from date of the letter...

My Question is:
Does my baby girl considered automatically British so I can apply a passport for her??
or does it considered to be applied for MN1 form as there is a gap in time between her birth date 24/07
and the date of H.O letter which is 04/08 ==== literally 7 days !! ===
taking into consideration that hasn't been registered till writing this post!

I need your help please and thanks in advance

Was your child born in the UK or abroad? If the child was born in the UK, s/he will need registration under Section 1(3).

This recent case suggests that even if the child was born the day before the status was conferred, the child would not inherit or acquire citizenship based on their parents' status.

Yes as your child was born before you were granted ILR so is not automatically British.
