Hi

I am planning to apply next week again.. VFS is accepting without Original HSMP letter. They said Refusal letter is enough..

Initially, I have shown 2 lakhs liquidity. Now, I am planning to show more than 3 laksh (by taking personal loan and gold loan)

Any suggestions welcome

All the best to the guys who are still waiting :)

Reasons for Refusal:

I have claimed points for HSMP approval during the period - june 06 to july 07. ANd got HSMP approval.
I applied for EC in dec 07. I remember while applying for EC - i have kept all bank statements and payslips from june 06 to dec 07, IT returns -of March07

The refusal letter will clearly state what documents were being considered while taking a decission and what were the causes for the refusal.

The letter says - He has considered payslips - june 06 to july 07 ; Bank statments - june 07 to dec 07, Tax return of march 07.

Since he could not map the payslips vs bank statments vs IT returns ; he says that he was not convinced as his opinion was that i might be having low funds before june 07! This was his first reason

His second reason:

He says the english language requirement letter that i produced from our college does not look original and looks like a scanned copy.

Finally he was saying: You have failed to shwo that you merit the award of poits for income under HSMP as you state.

ONe question to all the members:

He has retained my HSMp approval letter and English language letter from my college.

What should i do now:

For the income points- i shall again submit All payslips and bank statements and show him evidence that that i will get points for income.

For english language- what should i do now ?

nallan,

Again send the pay slips and bank statements frm jun 06 till dec 07.

For english lang, try getting a letter again frm your college...or else IELTS is another option

Appeals have to be made before 28 days from the date of EC decission.
IELTS - report may take long time!!
So, I feel a letter again from the college is the only solution regd English Language thing.

And - Can we apply for fresh EC - fresh application instead of appealing ?

Hi Nallan,

Best Option is to reapply for EC rather then going for Appeal.
If you want to lodge the appeal its good that you lodge with AIT
Rather then at Post.

Also Just make sure you supply English Letter from College Again.

Also Just try to show him your salary increement letter or your offer letter.

Just Reapply for EC coz Appeal takes lot of time.

Thanks

Gaurav

HI gupta,

Can we apply for fresh EC again ?
In the EC application form - there is a point asking whether do you have any refusal before . I will need to put as 'YES - REFUSED" right ? This might have effect in the fresh EC. What do you feel ? Pls suggest

Hi Nallan,

Mine EC was also refused in Nov'07. Then reapplied for EC in Feb'08.
Yes you need to put the Yes in refusal section.

But if possible try to get letter from college again and tell him

that you obtain letter again from your college as earlier letter with BHC.

Also if possible take the letter from Employeer about your gross salary stated in Payslip for claim period of HSMP.

And one more thing:

I am plannin gto change my job. I got an offer and i have to join them before march 10th.

In that case, I should put the relieving letter here and joining letter of the new company.

And my HSMP claim period - was the period i havbeen with my present company.

Wll that be a problem ?

Hi Guys,

I'm now planning to apply visa for my wife...However,I'm confused if I'll have to abide by the nw Tier1 rules or old rules as I'm holding the old HSMP...

Really confused and worried as the new rules states that I have to show 3 months of UK bank statement...

Somebody please clarify....

EC Refused and Re applied

Post by rams123 » Fri Mar 07, 2008 4:38 pm

Hi,

I am a silent member in this forum , I am working for a reputed MNC , applied EC in January with the following docs :

1. All the documents sent to HSMP approval
2. Bank statements authorized by bank official for the same period and till January08.
3. Pay slips but not stamped with employer
4. Original offer letter and original hike letters.

But refused the EC saying that 1. "Pay slips are not genuine and not at the stated age "
2. Bank statements are not genuine even though I authorized them with bank people.

Could you please tell me how come ECO takes this decision?

Now, I applied again with fresh application but I have small doubt on my new application i.e.I have provided all the original bank statements except February month as it was not generated when I requested the bank.

would it be an issue ?

Please share your thoughts on this

Why ? If they are online, as max companies in India do, you needed to get it stamped and signed.

EC Refused and Re applied

Post by rams123 » Fri Mar 07, 2008 4:50 pm

Hi gotcha ,

Thanks for quick reply , I did not have idea that they are signed & stamped , I thought bank statements with authorization are enough.

What does that mean ?

Are they online ? If yes, haven't you got it stamped ?
If they are on company stationary like letter head, then it's ok , not to get stamped.

If no, then, its negligiance on your side. Salary slips are considered very important evidence. Haven't you supplied stamped sal. slips for initial approval ?
