Peruvian married to Irish Citizien transitting via Gatwick

Post by Irishman30 » Tue Aug 08, 2017 2:10 pm

Hi,

My wife is Peruvian, living in Rep. of Ireland since 2013 with permission to remain.
She has all her Irish re-entry visas and permission to remain until mid 2018 in Rep. of Ireland.

Next month she will fly to Lima, Peru via London Gatwick with our daughter (Irish).
I (Irish) will not fly with her.
Her flight arrives from Dublin at the south terminal and leaves from the south terminal as well.
Her lay over time is 4 hours.
Her return journey from Peru is 3 weeks later and will transit via Gatwick on the way home to Dublin.

According to the UK visa site ( https://www.gov.uk/check-uk-visa ) - she doesn't need a transit visa as from I can understand she will remain in the terminal building and depart within 24 hours.
I confirmed this by ringing British Airways also and they confirmed she won't need a visa - even if her flight changes to the north terminal in Gatwick.

So everything seems ok however I am well familiar with airport officials from all walks of life (airlines, border control, customs, etc) who at times are unfamiliar with the rules and can tend to panic when they don't see a visa stamp in her passport.

So if anyone has any experiences or tips here, I would greatly appreciate the feedback.
Will she be ok without a visa or is she taking a risk?

If she has to change terminals, she will be OK if she has an Irish biometric visa - https://www.gov.uk/check-uk-visa/y/peru ... of_ireland , got to from https://www.gov.uk/check-uk-visa, and confirmed against the Immigration Rules at https://www.gov.uk/guidance/immigration ... itor-rules - Rules V7.6 to V7.8.
