Hello,

Hope you can advise me i am british citizen and im going to apply for my wife mexican national to come and join me but have a couple of questions i earn basic salary £18.043 per annum and i get overtime each month when is available and bonuses if i get them is based on performance.

I have 6 months payslips but i get payed 13 times in the year every 4 weeks

so i got 7 payslips that i get payed base salary 1388 per month plus overtime and bonus each month,

I want to know is that acceptable in Home office on the financial requirement is is categorey A or B

ON THE 6 MONTHS IS 7 PAYSLIPS BECAUSE I GET PAYED 13 TIMES IN THE YEAR 1388+1388+450+1388+20+1388+20+1388+15+1388+15+1388+146

IS £10382 IN 6 MONTHS BUT I GET PAYED 13 TIMES IN THE YEAR BECAUSE IS EVERY 4 WEEKS.

PLEASE HELP TO SEE IF I QUALIFY BEFORE SUBMITTING

You fall in category B cos its variable income but if you earned 18600 or more in last 12 months.

Example (c) Appendix FM 1.7: Financial Requirement May 2016
The applicant’s partner lives in the UK and is a fashion photographer who does short-term contract work for several agencies. He has periods without work and the amount he is paid varies from job to job. Over the last 12 months he has earned a total of £20,000. In the most recent 6 months his gross earnings are as follows: £3500, £0, £0, £2300, £3400, £500. The application is made on the basis of meeting the financial requirement under Category B non-salaried employment.
Under part (1) of Category B, the applicant’s partner’s current annual employment income = (gross earnings over the last 6 months, divided by 6) multiplied by 12= ((3500+0+0+2300+3400+500) ÷ 6) x 12 = (9,700 ÷ 6) x 12 = £19,400
Under part (2) of Category B, the applicant’s partner’s actual employment income over last 12 months = £20,000 So both part (1) and part (2) of Category B are met.

I disagree with the above post and believe you are able to apply using 'Cat A'.

The question is are you in salaried employment or non-salaried employment?

If in non-salaried employment:

6 months = 26 weeks
Total your gross income for 28weeks = A
A / 28 = B [Average income/week]
B x 26 = CALCULATED GROSS PAY OVER THE LAST 26 WEEKS/6 MONTHS

If in salaried employment:

£1388 x 7 = £9716
£9716 / 28 = £347
£347 x 26 £9022

Overtime:
£666/28 = £23.78/week
£23.78 x 26 = £618.28

£9022 + £618.28 = £9640.28 x 2 = £19,280.56 CALCULATED GROSS ANNUAL INCOME
