Today I received my package back with a refusal letter. Reason I did not include the ID of my ex spouse. Am confused right now. when we divorced I applied for retention of right(ROR) which was issued to me for another 5 yrs. I have gone 2 yrs into the 5 yrs. I don't know why they need the her ID when she is no longer my sponsor. I mate every other requirements but the ID.

Pls I need advice on what to do next.

Meanwhile my timeline is 4 months and 7 days.
It sounds to me they have made a an error. just to be sure, I would check with an immigration lawyer, perhaps you need to include a letter explaining your case and other documentation such as your divorce decree etc.

I supplied them with decree absolute and a letter confirming my ROR when I applied. Even the sticker is in my passport. I actually don't know what to do now. The gave 14 days to appeal or resubmit.

I believe you just have a couple of options, 1) If you absolute certain, contact an immigration lawyer and and upon explaining your case ask him to draw a letter to you case worker explaining why the decision was made in error and appeal, as he may have a deep insight of what the caseworker have missed, or just ask your ex partner her Id and include in the application. Whichever is easier. If is the case the the caseworker made an error, you can contact your MP and ask to interview as well. But I would make sure through a immigration lawyer first to make sure you got everything right.

Ok thanks for the advice. I tried to email my case worker with the email address format I got from here but the mail returned. I will call HO on Monday and take it up from there.

Yes ...the waiting is a pain. I would think you are only a couple of weeks away from getting your PR though. As annoying as not receiving the COA is, unless your employer specifically requests it, it is not that big of a deal.

Hope you hear some good news soon!

You are a second person on this board who's application has been refused due to lack of ID.
Is it a refusal letter or your application is invalidated?

I think you can contact your MP there was someone in this board that have The same problem and he contacted the mp and OH apologies to the person. Really I think they don't need it.

You need to go to a solicitor. Pap is pre action protocol which you write before taking them to judicial review.(upper tribunal) there no point writing to case worker as they don't reply.

Hi All,

I am concerned to hear of this issue with refusals due to ex ID not being submitted. I too am applying for PR on basis of ROR granted in 2015.
I did not submit my ex ID but I did include a cover letter explaining we are no longer in contact and that I did not submit his ID when applying for ROR and am submitting exact same info as I did for ROR.
I will keep you updated.

Just a question - did you all get usual Biometrics, COA etc and only after the 5/6 months was there a refusal or was it an outright refusal?

My details (no idea how to do a signature)

Non-EEA applying for PR on basis of ROR

12/07/17 - Application submitted
14/ 07/17 - Money was taken out of the account
15/ 08/17 - Confirmation email received
16/08/17 Biometrics Letter Received and sent off same day
COA: Awaiting

Hi
ROR
According to home office guidelines case worker will
Issue Long COA with right to work or Short COA without right to work
Depending the document available to them.
So any applicants who did get Long COA with right to work did falls under the HO case worker guidelines therefore refusal.
