Switch to Tier 2 General from Tier1 Gneral Dependant visa

Hi

I am currently on tier 1 general visa due to unfortunate my ILR visa has been refused , so My wife found a sponsor in UK to apply for tier 2 general but the employer is saying my wife do require a 12 month cooling off period but it is no where written on gov uk website .
her employer is asking a evidence to show that my wife do not need to wait 12 month cooling off period can some please help me with any evidence to show my employer that i do not have to wait 12 months cooling off period.??

There is no 'evidence' because there is no such requirement. The 12 month cooling off ONLY applies to Tier 2 applicants.

A Tier 1 General dependent is free to apply at any point, from home country.
