Tier 2 Dependent Extension - ILR 6 months short.

Post by hammad2224 » Tue Sep 19, 2017 1:01 pm

Hi Experts,

I am on Tier 2 General Eligible for ILR in JULY 2019
and My wife is on Tier 2 General Dependent Expiring 29/01/2020
She is short 6 months as her 5 years completing in 14/07/2020

Question 1) If i get ILR in JULY 2019 then can she get extension for her TIER 2 GENERAL DEPENDENT till 14/07/2020 so that she can complete her 5 years route. Or she needs to apply for FLR which will reset her 5 years clock?

Question 2) My daughter is born in MAY 2016 and she is Tier 2 General Dependent visa expiry date same as my wife 29/01/2020. Can she apply for ILR with me or she needs to wait for 5 years or she can be eligible for Naturalisation after my ILR?

Thanks
Regards,
Hammad

1. Yes, she can apply for an extension. It will be a 3 year extension.

2. If born in the UK, you can apply to REGISTER (for children) her as British once you get ILR. If UK born, she DOES NOT require ILR to register.

Thanks CR001
I have one question bothering me regarding this answer as
After my ILR no one is Tier 2 General Main applicant then how can she get extension for her Tier 2 General Dependent.
But still if she gets extension then which application she needs to fill Tier 2 general dependent to get an extension which you suggested?

Regards,
Hammad

If you get ILR based on 5 years Tier 2, then the rules permit her to continue as a PBS dependent until she qualifies for ILR. She applies for a 3 year extension as a PBS dependent.
