ILR AFTER 6 YEARS OF DISCRTIONARY LEAVE PERIMIUM SERVICE

Can anyone help me.
My ILR is due on jan 2018 i was granted after failed asylum under legacy. My question is i want use perimium service and i would use dl form but there is no option of perimium service fir this dl form, but some solicitors advice me i can apply through perimium services, has anyone know about it kindly share it will be great.

Maybe I'm wrong but wouldn't you be using SET (O) form for ILR afyer 6 years of DLR?

As far as my understanding is, isn't form DL for the further grant of discretionary Leave?

DL FORM is also use for SETTLEMENT. There is clearly written on the form. when i was granted 3 years of DLR i did fill the DL form because my asylum was refused and i was granted outside immigration rules.

Ahh that's why i was confused, As my wife was granted DL too (currently on that) but hers was non-asylum that's why.

I have done a bit of searching, According to a source (3rd party) which i cannot mention here nor will i post the link.

they mention that premium services can be used for those granted DL (before 9 July 2012) on the applications FLR(O) to extend their DL a further 3 years, or SET (O) for indefinite leave to remain. It also states this service is only available to applicants who have never previously claimed asylum, any applicants refused asylum and where granted DL as a result must still apply by post using the form DL.

again the above info was valid from December 2014.

In addition of you check the UKVI website for online booking, click here, you will see the accepted FORMS that can be used with the premium service, unfortunately form DL is not included.

Actually there are two things mixed i am also bit confused on the other hand if you can read this statement which i copied from ukba website is also not very clear to me.below

"You also can’t use the premium or super premium service if you’re applying for discretionary leave to remain or humanitarian protection unless:

you’re applying under the transitional arrangements to extend your discretionary leave after 3 years
you’re applying to settle in the UK after 6 years discretionary leave"

Again when you try to book it
Right near the bottom if you click settlement just under who can use this service it gives you a list of applications that would be eligible to book the premium service.

If you had DL non asylum and it is 6 years qualifying
You would use SET (O) and there is the premium service available for that.

Again I didn't see any Form DL in there.

i have just read SET O form guide which i copied below can you please read the last sentence which is
,other purposes/reasons not covered by other application forms[/b] CAN I WRITE THIS REASON IN MY APPLICATION BECAUSE THERE IS NOT PERIMIUM SERVICE WITH DL FORM. Thank you

Form SET(O) must be used if you are applying for indefinite leave to remain in one of the following
categories or routes:
 Tier 1 (General)
 Tier 1 (Entrepreneur)
 Tier 1 (Entrepreneur) - Accelerated route
 Tier 1 (Exceptional Talent)
 Tier 1 (Investor)
 Tier 1 (Investor) - Accelerated route
 Tier 2
 PBS Dependant route
 employment not requiring a work permit e.g. representatives of an overseas business
 highly skilled migrant under the terms of the HSMP indefinite leave to remain (ILR) judicial review
policy document
 bereaved partner route
 UK ancestry route

You can apply no earlier than 28 days before or within. 28 days of the qualifying period of 6 years continuous DLR.

You could also apply 28 days before visa expiry as well, even if it takes it over the 6 years of DLR.

Again this form FLR DL is very specific as it states this from is for the following categories:

'' An application for settlement from a person refused asylum and granted Discretionary Leave''

Form FLR DL

Again as these cases are complicated compared to a non asylum grant of DLR as they would use form SET (O) it is best to seek professional advice and get some clarity.

Also if you have a look at FLR DL it does not ask for many documents as compared to SET (O) apart from what questions that need answered and your BRP card and passports.

I still need to decide the right Form SET O or DL.
I would get legal advice. My 6 Years will be completed in Jan 2018.

If you are asking me, Personally for my wife's case, we will apply 28 days before expiry of her visa (making her DLR continuous of 6 years and 1 month) and will go for the PEO appointment (premium) on the SET (O) application, hopefully June 2018.

my 6 years are going to complete in december in 2017 and visa expire on may2018
i had confirmed with home office in writing through MP that i could apply in december 2017 so upto that point there is no imbugity

as long as from is concern my research say FLR DL is right form and postal there is no premium service availble
although in SET (O) we can present our case but there is huge fees on at risk

so far only one solicitor is saying you could apply premium on FLR DL rest all saying postal

I am going to meet one of Solicester in London next week with my all paper work.
I had email conservation he was sure I can apply through perimium services.
I know some people in this forum they did apply asylum and was refused they got granted ILR through PERIMIUM SERVICE. I checked the previous Posts which was related to 6 years DLR to ILR people had similar situation to my case but I defiantly get legal advice before I applied through PEO.

I spoke with 3 solicitor today
Two of them said FLR DL is the only option for ILR and application must b postal but we cud apply as soon as six year complete

One solicitor said that he could try with SET O form and home office will accept most likely he told that he had successfull application of his client recently

I know it’s difficult to decide yet but still we can apply Through SET O. The only reason to choose SET O form is Perimium service otherwise there is not big difference we don’t need to meet the financial requirement. But it’s very import point We should not have any criminal record and we would apply under section 10.1 which is after 6 Years of DLR.
NO NEED ENGLISH TEST REQUIRE
ILR FEE +PEO FEE
NO MEDICAL SURCHARGE
My understanding is All Solister have different opinion.

Members are not permitted to name any solicitors on the forum. If you want to use a solicitor, you would need to find one you are comfortable with yourself. A solicitor has no influence on your case/application and caseworker also will only speak to you if you go premium service.
