Spouse VISA Refused can one apply for visit visa

Post by jamalkhan » Tue Mar 11, 2008 9:05 pm

A freind of mine has just been refused a spouse visa due to some confusion in documentation.
his wife had her Title as Mrs since she started working but she never noticed it. The EC blammed her for being already married and the refusal notice was on the basis of polygamos marriage.
She is now appealing

However my question is, can he apply for Visit Visa and spend time with his wife here until his appeal gets prossed. Just to mention she is already preganent

hi,
by getting refused on the spouse visa your friend has got a bad immigration history. his visit visa application will be refused as he has to mention in the visit visa application form that he was refused on spouse visa once.
the best way would be to go through appeal route which I understand they have already inititated the process.
it is time consuming but that's the only way to put records straight. otherwise bad immigration history will create hell of troubles for your friend & his wife.

technically it may be refused as the previou appplication was for Settlement, and now the person applies for a temporary visit ?

All depends on the merits of the application.

For example, a visitor visa to attend an appeal in the UK is likely to be granted.

It is unfair
He is a genuine applicant and his wife is also pregnant. The appeal process will take 6-9 months. He cannot be here??

The fact that she is pregnant shouldnt have anything to do with it.

I say it all the time on this forum - if you dont go over your application with a fine toothcomb and pick up issues like 'miss/mrs/spelling mistakes etc etc' then it could prove crucial.

Its quite common for applicants in the subcontinent to have 3-4 ways to spell their name; different dates of birth on documents etc.

Time to take these things seriously!

Any chance you could post the actual wording in the rejection? Usually what people say & post ends up differing what was actaully stated in the rejection document.
