Filing EC in April with HSMP letter from Mar2008

Post by sameerg » Fri Mar 14, 2008 8:03 am

I am posting this message here since March thread talks about EC applications not the HSMP applications.

Have submitted my initial HSMP application to HO on 12/MAR/2008 from Mumbai. Waiting for the Approval letter.

My Questions is : For those who get HSMP approval letter in March and go for EC in April do they need to follow old HSMP process ? any idea ?

Thanks
Sameer

March applicant

Post by bentley » Fri Mar 14, 2008 8:16 am

Hi,

the exisiting thread is for MARCH EC applicant , there is no thread for HSMP. Thus started a new one.

First question, what difference will be there in EC application as a process for march and after march(once the rules are changed). I guess the rule to enter will be same , the only change would come for "maintenance support" part only.

Please correct me if anybody has other view .

Hi ,

My details

Docs sent - 7th March (from New Delhi)
Docs recd - 12th March (8:38am GMT)
Money deducted - 12th March (11:00 am GMT)

I have applied from India, waiting for reference number. Sent a mail to HO , immediately a canned response came that all case workers are busy due to heavy rush and will be not be able to reply anything on emails.

I have left hope of getting reference number via email. anybody has any clue ??

cheers.....

HSMP in March - Reference number?- EC -Old/New rules?

Post by besttime » Sat Mar 15, 2008 12:05 pm

Pals

When do we actually get the reference number? My application has reached HO on 13th March.
For march HSMP applicants, does the EC comes under new rules or old rules?

Good time

From looking at other posts... I estimate one week (from the credit card charge date) for the email to arrive with the reference number.

Extracts from http://www.bia.homeoffice.gov.uk/workin ... angements/

Transitional arrangements for those with an HSMP approval letter
The Highly Skilled Migrant Programme (HSMP) has closed for applicants in the United Kingdom, and will be closing for applicants in India in April now that Tier 1 (General) - highly skilled worker of the points-based system has been introduced. If you are in the rest of the world, you will be able to apply later in the year.

On 1 April 2008 Tier 1 (General) is introduced for applications for permission to enter (known as 'entry clearance') made in India.

There will be a number of applicants who will be part-way through the two-stage application process (application for HSMP approval letter followed by a separate application for the associated entry clearance or leave to remain). A number of people will have already successfully applied for an HSMP approval letter but will have yet to apply for entry clearance or leave to remain. HSMP approval letters are valid for six months from the date of issue.

Arrangements have been put in place to allow those who have an HSMP approval letter to apply for entry clearance or further leave to remain by making a Tier 1 (General) - highly skilled worker application. They are:

if you have made an application for entry clearance as a highly skilled migrant before 1 April 2008 in India only, and it has not been decided before that date;
if you have made an application for leave to remain as a highly skilled migrant before 28 February 2008, and it has not been decided before that date;
if, on 1 April 2008, you have already applied for a Highly Skilled Migrant Programme approval letter (HSMP approval letter) but have yet to apply for entry clearance as a highly skilled migrant; or
if, on 29 February 2008, you have already applied for or obtained an HSMP approval letter but have yet to apply for leave to remain as a highly skilled migrant.
If you apply with a valid HSMP approval letter, you are charged a reduced Tier 1 (General) - highly skilled worker fee for your application. Read the section on costs to work out the fee you must pay.

If you have been issued with an HSMP approval letter, you must now make a Tier 1 (General) - highly skilled worker application. You are automatically awarded the 75 points required to qualify under the attributes points assessment of Tier 1 (General) - highly skilled worker and will not need to show you meet the English language requirement.

You do not need to fill in the attributes section, so you can go straight to the maintenance section of the application form.

If you already have a valid HSMP approval letter, you should go to the maintenance section of the points assessment and complete the rest of the application form.

Tier 1

Post by bentley » Mon Mar 17, 2008 10:25 am

if HSMP application goes successful, so there would be only tier 1 application(replaced in place of EC) to be submitted with maintenance cost support evidence and once tier 1 gets approved by submitting another fees of 350GBP(400GBP already paid ), one needs to apply for visa in India at british embassy.
Please confirm the understanding or correct the flow.

If my understanding from above is correct, that means there is three step procedure for a HSMP qualified person .
I think one doesnt need to goto indian embassy..i have heard not READ documents yet, that there is only one proecdure for approval and visa together..is it?? I am not so sure just asking you answer formy query.

The workflow is like this
HSMP application -->EC (apply for visa in British embassy in country of origin )

after 1st April

single application
Tier1 application and upon it approval ,one has to go to local British embassy to get Visa.

Getting reference number does not mean it was assigned to a caseworker for processing. I believe they are still processing Feb 3rd week applications.

If Ref # is assigned after 1st April, while application and fee deduction done before that so will it be considered under TIER 1

Applying on 24th March

Post by bossvikas » Fri Mar 21, 2008 11:54 am

Hi
I was planning to apply for HSMP on 24th March 2008.
I had a few queries regarding this.

1. Will my application be even considered or should I wait for April 1 under Tier 1? From what I have been reading, if my application reaches before 1st April 2008, it would be considered under current HSMP guidelines.
2. If I get an HSMP approval, it will obviously be after April 1. So, then to apply for EC, would I have to:
a. First apply under Tier 1 maintenance costing 350 GBP.
b. Apply for a visa. If so, what is the cost?
3. Would I have to give IELTS to meet English Language Requirement?

Thanks in advance
Vikas Manghani
