Online Investments as a tier 4 student

Post by hhofficial123 » Thu Oct 12, 2017 2:18 pm

Hi there,

I am a tier 4 student in the uk, I am aware that self employment is not allowed on a student visa. However I want to know if I can invest in forex currencies online and buy shares on student visa? because HMRC says that if you make profit from buying shares or trading in forex you're supposed to pay tax. But this looks like a grey area to me so does anyone has the answer if an international student can do this in the uk or no?

No, and I don't agree it is a grey area. If you are doing it to make money, which I assume you are, it would be a "business activity", which is not allowed.

It's one of the areas of work covered in UKCISA's recent blog, "A working definition":

As per the link provided, I believe you can do online trading in UK stock market i.e. buy/sell shares

"Owning or dealing in shares

You can buy and own shares, but if you own more than 10% of the shares in the company (including if they are held in trust for you) you cannot work for the company. This is one of the specific examples of “business activity” in the Tier 4 Policy Guidance.

If you regularly buy and sell shares in order to make money, this is likely to be seen as “business activity”. If you make a dividend income from shares you own, you must pay income tax on this income."

I disagree. Trading is highly likely to be seen as a "business activity".
