hello to every one { urgent advice}
my self abs,

i was apply ILR IN august 2015 on 1o years long residence was refuse due to TOEIC appeal right given in 2015.

won in June 2017 form lower tribunal court base on TOEIC, home office appeal against the decision in july 2017,

again won in august 2017 form upper tribunal base of TOEIC home office not gone to court of appeal .

contact to m p to implement the court decision and requested mother ill health in back home india.

now in October 13 2017 home office send me letter to accept discretionary leave for 2.5 years but not give me ILR.

my question is can i go for PRE ACTION PROTOCAL PAP IF YES can any one have an idea how many days it take form today date 21 october 2017 to complete n challenge the home office decision to be revise or shell i accept home office discretionary leave for 2.5 year n then apply for again ILR. really confuse what to do i have only 48 hours to take decision . please can any one replay me soon .

Sorry to hear about this.

If you accept the DLR, I think you can reapply for ILR again on the basis of 10 years? Best to check with a solicitor if this would be possible.
You can go for PAP also.

There are a couple of people on this forum who went for PAP after appeal, though in their case the appeal was rejected. They applied for Tier 1 Entrepreneur, but still, PAP process is the same.

yes u were correct i contacted to solicitor but he says it will be a problem to get ILR in case if home office refuse in future after accepting DLR then again we needed to file a case and also i decided to go for PAP by this Monday 23/10/2017 still needed to know how many more days it take the whole prose for PAP or a weeks . many thanks for ur time to replay me .

Because your appeal is allowed in both courts

HAUNT OFFICE :wink: should not be able to any further problems

Just pray that they issue visa ASAP

dear senior members needed advice on pre action protocall

i have send by my solicitor a pap action notice to home office on 11 December 2017 and home office has replay on 19 /12/17 for implementation of my appeal allow by UTT !

home office said it been pass to decision making team on 19/12/17 . my question is how many days or week form 19/12/2017 it take to get my ILR AND PASSPORT TO BE ARRIVE please any one have a idea about i[/glow]t . thanks Q

I'm in the same situation like u applied for ILR in nov2015 got rejected in 2016 June, finally appeal was allowed on 6th of DEc, last week got a letter from the post-decision casework unit saying they gonna implement the Tribunal decision soon.
