Good evening everybody
I was wondering if you could please advise on my case as well.
I currently hold a spouse visa for a British citizen.

I was granted my visa on 20 Oct 2012.
I entered the UK on 8th Dec 2012.
My visa was renewed after the initial 2.5 years and will expire on 17 Jan 2012.

I have read the requirements on the official Home Office website and I'm not clear when I should apply for indefinite leave.
- Would it be 28 days before the day I entered the UK (i.e. 5th anniversary of my visa)? 11 Nov 2017?
- or Would it be 28 days before my visa expires? 21 Dec 2017?

I would be grateful if you could please shed some light on this matter as I'm a bit confused on which is the correct day I should be applying.

This one. You can apply at ANY time within 28 days prior to the anniversary of your date of entry. You can apply by post or in person for a same day decision.

Most people apply within 28 days of reaching 5 years. It is allowed. Not sure what your concern is.

Hello ,
An Immigration lawyer has advise me that I can apply 28 days before the date of my visa was granted 20 Oct 2012. wch

the lawyer message is below

"The period between when you were granted your visa on 20 October 2012 and when you entered the UK on 8 December 2012 can count toward your continuous period in the UK, however, this time will also count toward your allowable absences of 180 days in a 12 month period.

Providing that you have not breached the absence limits, you would be able to apply 28 days prior to 20 October 2017."

I have also contacted UKVI again and they confirmed that !


Can someone please confirm that I can apply on 23 September 2017 ? as I don't want my application to be rejected and lose my money .

Also , any sharing past experience are welcome !

The immigration advisor is WRONG!!

Your residence period starts from the date you ENTERED the UK.

What the 'advisor' is referring to is ONLY applicable to PBS main visa holders (tier 1, Tier 2).

Also, there is NO absence limit for a person on a spouse visa.

I have contacted the immigration advisor again and told him what you told me . below his answer

"
Thank you for your email.
I had overlooked the fact that you started you were on a spouse visa and I gave you guidance based on being a PBS dependent.
I can confirm that with spouse visas, you would be able to apply 28 days prior the date of entry, therefore you would be able to apply 28 days prior to 8 December 2017. "

He is still wrong though on his previous advice as it also DOES NOT apply to PBS Dependent spouses. His first advice is only applicable to the main visa holders of PBS route not their dependents.

Heaven help people that go to him/her for advice

I have booked an appointment in Croydon premium service for my ILR application
on Monday 13th November 2017 , is that will be fine with 28 days rule ? please note that my first date entry to UK is 8 December 2012 - under SPOUSE OF BRITISH CITIZEN - 5 years route

Also do I need to do a copy of all document or just original ? And what other advise can you help me with please ?

If 13 November is WITHIN 28 days before 8th December then it is fine.

I went to my Bank "Barclays" to print and stamp my 6 months bank statement. they refused to stamp it manually but they advised that I need to print all bank statements from the machine in the branch as it comes with an electronic stamps on each pages . on the stamp it's shown certified copy Barclays and name of the branch with date and time, under the electronic stamp there is a sentence "printed on self serve machine"

the bank manager has insisted that it's approved by the home office .

can someone confirm if these bank statements are OK for ILR application

You are better asking them if bank statements could be ordered and sent to your home and pay the fee if any(I think £5 for a full year, may vary) My understanding is even in store printed bank statements may have a different format that UKVI might not accept although they may be approved/genuine.

Nornally it shouldn't take no more than 5 days for it to arrive to your registered address.

I am also collecting documents for ILR, though I got 4 months to go.
I have requested the Bank statements for 2 years by online NatWest chat. They said the statements would be delivered in 4-6 days, that to free of charge.
You should check with your bank.

I managed to get all my bank statements stamped after I printed it all in the Barclays brunch, then I explained the situation to the customer adviser that HO required a MANUAL stamps for bank stattment for ILR application, so he understood the situation and stamped all statements for me
