Tier 2 Job Start date

Hello,

I am new to this forum hope anyone can help.

I have applied for tier 2 visa my joining date mentioned on COS has been passed my COS status is still not used according to employer. Does my employer need to change start date? Is it compulsory to change start date?
Also I have provided the offer letter with application so if start date needs changing on COS will it be a problem as offer letter date is old one?

you should contact an immigration solicitor, your HR may pay for it, my advice though not an expert advice is that you should also see if you have valid current leave to remain, whether you can take up employment with this new sponsor as a second employment for restricted time period...
my guess is that your new sponsor can change that is move further your sponsor start date through SMS (sponsor mgmt. system) before it is used but there is little benefit I see but I may be wrong

Thanks my sponsor is ready to change the date as i cant join them until i get the visa but my question is is it allowed to changw start date once your application is pending as i read it somewhere on this forum its not allowed.

Hope experts can suggest. Experts please advice.

sorry, I don't know what benefit in changing dates, btw when did you apply before start date, what method postal or premium? are you on 3c?

i cant start until i get visa my current leave is still valid and yes i did apply before joining date it was through postal. I am not sure about the benefit that was my question actually as if i didnt join does employer need to update on cos amd add new start date?

Hi,

So long as you applied before used by date of your CoS, you should be fine. I'm about to extend my T2 but have a look at dates for my restricted CoS when I got my first T2 from outside UK:

Current certificate status: USED
Current certificate status date: 22 January 2015
Date assigned: 20 November 2014
Expiry date (use by): 21 February 2015

Work dates:
Start date: 10 November 2014
End date: 09 November 2017

I applied on 13 January 2015! and got the visa 2 weeks later. interestingly, Visa issuing and expiry dates are: 22 Jan 2015 and 09 Dec 2017. I doubt the working start and date is that important.

are you leaving your current job?.. if ok why not ask your current sponsor if you can work for 20 hrs max in new job if soc codes are same..update us ...

Thanks hbbb for your reply with reference to your case it seems like it wont be a issue then as i was thinking employer needs to inform homeoffice if employee doesnt join so they need to update cos.
Got yes i am switching employers and Soc codes are different
