Yes I agreed. But when they updated on system for 1 year . They mentioned de facto relationship is 1 year for Irish national or Irish resident clearly. Which screen shot I have clearly mentioned. So what they mean by Irish resident????? If you can tell me please. EU citizens are not Irish resident?????

I think u as Spanish citizen, working in another eu contry is eligible to use the eu treaty rights, with that the easiest way if u get married, or stay unmarried but than prove 2 years relation.

They do a fantastic job in the face of folks trying it on and attempting to cheap the system.

Granted leave to people with no tangible commitment to a local or EU citizen is like giving one to all a sundry. If you are unwilling to commit to legal partnership why should Ireland commit to granting your inamorata leave to remain?

I am not here for arguing !!!! Just simple is that if you think 1 year is not enough then there is nothing enough ....bcz they reverse it from 1 to 2 again. And it was fir irish national and irish residents. I can say like you too. It donesnt matter for me. I said whatever I know correctly with evidence.

You are right. Due to your link to INIS the co-habitation time for irish nationals was lowered to 1 year in the time frame early 2017 till 31 october 2017.
If you applied in this time frame the 1 year was also valid for you. Due to article 18 of the treaty discrimination on grounds of the nationality are not allowed for eu citizen.

EU citizen cannot be handled less favorable than irish citizen in such a case. That is was article 18 of the treaty is saying.

The image u uploaded won't show up to me, so i still don't get it where did u get the idea that this 1 year rule applied not only Irish citizens but Irish RESIDENT. U are Spanish , not Irish, therefore that 1 year rule never applied to u. For eu treaty rights iy was 2 years always. Plus, immigration will argue with u so long that 2 years will pass anyway. So, again, prove 2 years or get married.

Is it so hard to understand article 18 TFEU (Treaty on the Functioning of the European Union) ?

Ok, so specifically it was never said, for Irish residents too, its just logical from article 18, so if its 1 year for Irish than it should automatically apply to eu citizens too, well, good luck with that, i would bet all my savings that immigration will care less about this logic. Just like what are they doing with the eutr visa... Or the 6 months max decision time for eu4fam resident cards, those don't comply with eu rules, and still inis don't give a damn about it. My bet is this 1 year and article 18 argument will be simply ignored or thrown out.

just to be sure,
if i have translate marriage certificate from my country (Israel) do i still need to provide 2 year of proves of address?
she is Lithuania citizen and i'm Israeli citizen.

Anyone can help me how can upload a photo here. I have the screen shot where inis declared cohabitation is 1 year for Irish national or Irish resident on earlier 2017 to until august 2017. If you anybody interest to see I can send it to email.

Hi mgb...I am not convincing anyone here. Only was argument on that ground. Bcz someone said earlier 2017 was not 1 year for Irish resident except Irish national . My argument was on that point bcz I have evidence of declaration. However inis reversed it 2 years on September 2017 with mention only irish national which is funny i think bcz they mentioned bfor irsih resident too. ********And my enquiry was that EU citizens are Irish resident or not?????

U have to argue with immigration, at least u have something to start with. i only can give my opinion, i have some experience as me and my wife going through this visa and eu4fam card process, now she is accepted for eu4fam. U might pay a solicitor if ur stuck, but in general i would not advise that, cause with eutr u can do everything for urself, just like we did, but its ur call, and ur route.

Anyway tnx Julo for reply....I made already review through solicitor. My solicitor is over confident against my case and said it is not fare disicion. Only bit sad due to inis unprofessional judgment. They gave plenty dodgy fake visas but they are strict for genuines.

Hiiii.......today I received a email response from eutreaty right unit and said that they are looking review cases at this time whose are submitted on January 2017. But I submitted on September 2017. Will it take around 1 year for review!!!!!!!!!

*******Anybody can tell me that if department approved review will they give me 5 years card or temporary stamp ( bcz they didn't issue any stamp when submitted application)?????


*******can I request them temporary stamp while file is on under review ????

you have three options.

Chase Department, involve Local TD etc

File Judicial Review against unnecessary delay.

Move to any other country with EU Partner or register your marriage and become Direct Family Member instead extended family member.

if department issue you teporary stamp on your first file, they sent it stamp on review as well.
if department donot sent you temporary stamp before it is highly unlike they will sent it now.
In my case, they give us 9 month temporary stamp, they 10 month on review. even our review was refused as well now. and case in repatriation unit.

Hi arz...tnx for comment.....Can you tell me why they refused your case on review? What they raised issue?? My case I explained here on top. Even they are not happy with the documentation I submitted.
1 year tenancy confirmation along with 15 separate bank, credit union, gp etc letters from both side to cover whole year
Another 1 year all separate 6 letters from my side like gas Bill, credit union letter etc and 10 letters from my partner side like bank, credit union , gp etc.

Another 4 months current address tenancy agreement and all joint bills

**** they raised my documents is quiet limited.

we are EU1 dependent parent case, they r not satisfy with the dependency prior to the state. If you donot send any document new against that allegation you r in trouble. on same paper they already made up the mind. they will refuse the review with in a month and file will be transfer to repatriation unit. I wish it will not happen to you.

Hello arz tnx for reply. I got refusal on September and made review through solicitor. I sent more than 2 years cohabitation proof , child birth certificate, EU citizen job contract until July 2017. My partner still working with same company. After July we got some bills and bank statement until today which didn't send. Is there any advice for me from your side ????
