(URGENT) Tier 2 general - switch from Main applicant to Dependant

Hi,

I am on Tier 2 general main applicant from Dec 2013. My wife was my dependant till last month but now she has become Tier 2 main applicant coz her company sponsored her for five years.

I am still holding my Tier 2 general main applicant visa. My employer company has been closed and another company has taken over it. The new company who has taken over does not have sponsor license but it has applied for it. Also TUPE has been applied.

Can you please advise me ?

1. Shall I switch from Tier 2 general main to Tier 2 general dependant ? My wife dependant coz now she has her own visa.

2. What is the new company does not get sponsor license ?

3. I will complete 10 years in Uk in 2020. But I went to my country for 190 days in 2012. But rules says applicant should not spend more than 180 days outside Uk in one calendar year. What if i become my wife’s dependant and apply for ILR in 2020? Will 190 days cause any problem? Can I show any document why I was in my country for more than 180 days like doctors letter etc?

4. Any particular format for doctor letter?

5. What do u suggest? Shall I remain on my current visa and wait for new company to get license OR become my wife dependant and apply for 10 year route ILR in 2020?

Many of your questions have been answered many times already in many of your previous topics you have started (click) so not sure why you couldn't just continue in an existing topic instead of starting a new one with the same/similar questions again.

1. YES (again).

2. Your visa will be curtailed/cancelled.

3. You don't have 10 years continuous residence. 180 days or more absence breaks your 10 year legal stay.

1. My friend told me that if I submit any certificate from the doctor that I was not well and stayed a few days more in my country (190 days) then it would not be any problem and I can apply for ten year route.

I was thinking to become my wife’s dependant for now and in 2020 apply for ILR on ten year route. My wife will apply for ILR after 2022 as she will stay on her 5 year Tier 2 visa.

2. Any other option where the HO can consider my ten year route application on more than 180 days? I m just ten days more than it 190 days in 2012.

Your 'friend' is wrong. Members have been refused ILR Long Residence for more than 180 days absence with evidence of parents cancer and death. You stand no chance.

You don't qualify for ILR based on 10 years residence.
