Need Advice 10 Year Route

Post by naveedcardiff » Wed Aug 16, 2017 1:48 pm

Dear Sir

Currently I am on spouse dependent visa and my husband has British Passport. My indefinite leave to remain is due in next year end of July on the basis on long residency route (10 years route) and I still can stay 300 days out of UK because in last 9 years I was out of UK for 200 days. I have few queries.

1) In my current last year, for how long I can stay continuously out of UK. It is 120 days or 180 days.
2) For how long I can stay maximum number of days out of UK in the last year (10th year).
3) Can I take two exits of 120 days or 180 days out of UK in last year? If yes How many days I should stay in the UK between two exits. For example if I take two exits of 120 days or 180 days.
4) If I get ILR for how long I can stay out of UK without having any implication for Naturalization. It is one year or two year or three year.

Thanks

1) In my current last year, for how long I can stay continuously out of UK. It is 120 days or 180 days.

Any absence of 180 days or more breaks your continuous residence.
2) For how long I can stay maximum number of days out of UK in the last year (10th year).

There is no limit for the '10th year' for ILR
3) Can I take two exits of 120 days or 180 days out of UK in last year? If yes How many days I should stay in the UK between two exits. For example if I take two exits of 120 days or 180 days.

So you don't really want to be in the UK but you want ILR?? Why do you need to travel for so long shortly before you need to apply?
4) If I get ILR for how long I can stay out of UK without having any implication for Naturalization. It is one year or two year or three year.
It depends on your total absence in the 3 or 5 years your citizenship is based on and how many days in the final 12 months you were absent.

Maybe you need to think what is more important and plan accordingly.

Dear Sir/Madam

Thank you for kind reply. One more question.

1) I got UK visa that started from 27 Aug 2008, but I came in the UK on 28 Sep 2008. Can I apply 28 days earlier for indefinite leave to remain? If yes
• Should I count 28 days from 27 Aug 2008 or 28 Sep 2008? I will submit my application on 27 July 2018 or 27 Aug 2018?

Kind Regards

or 28 Sep 2008
Long residence ILR is calculated from the date of ENTRY. You must meet the absence limits otherwise your application will be refused.

You will not get your ILR if you still think that, quote : "and I still can stay 300 days out of UK because in last 9 years I was out of UK for 200 days."
