What if an AIT appeal is UNsuccessful what happens next?

Assalamu Alaikum and Salutations everyone!

I hope you're all well.

My ex-wife's appeal hearing is in a couple of weeks, I was enquiring as to what would happen if her appeal is unsuccessful or successful.

Basically the hearing is about my ex coming back on a visa spouse that was retracted and after lying to the Immigration Officer she was informed she had no right to stay, but she has the right to appeal as we're a fair country.

The Immigration Officer did say some scary stuff - that she might say that she was a victim of domestic violence and that I forced her to sign the divorce papers.

I've spoken to the police after my wife rang her and I told her we were divorced and that she needed to get on with her life.

She told me to go to hell, and that she would be "watching" me.

I informed my family what had happened and they rung the police, then I started getting nuisance calls from random no's and people laughing down the phone.
I then received calls from my ex @ my place of work where she would be rude & aggressive to my colleaugues - As i work for the local council all calls are recorded.

I rang the Border and Immigration @ Manchester and they stated that "perhaps it was best not to pursue this" as she could get tied up in a police investigation, as the IO stated she used lie after lie to get them to release her.


So what I'm trying to ask is if the judge dismisses her appeal.
What happens next?
Is she given another right to appeal?

And if the judge does allow her to stay?

I never believed that she lied even though my friends and family said she did.

But I have to face the facts and know she did lie - as the IO would have no reason to say she lied, also police would have no reason to lie as my ex stated to them "that I still had her belongings."
I know this isn't true as I gave her everything she owned plus some of stuff eg. my notepad which I kept my thoughts in, she took after I removed my pages, also she was a little short and needed a sub until she could get to Pakistan and get access to her a/c.

Sorry for the post being so long - anyone got any experience or thoughts on what could happen.

BUt she's not your wife - legally you have nothing to do with her (and vice-versa). Dont see what your problem with her appeal is now that you are divorced. The emotional stuff means JACK in courts.

Just get on with your life. Otherwise you are going to be a bitter man for the rest of it.

I'm not bitter, just very hurt bro.

So none of her allegations will stand up @ the hearing.

I'm assuming the judge will have read some of the background???

And who's Jack???!!! Joking man - - - lol

I've informed her she left me & I no longer want anything to do with her, but I keep getting nuisance calls @ work!

And as the IO stated any investigation could tie her up here, I have to ignore it. Which I'm trying to.

Just been informed the appeal hearing is next week...

Lets see which lies they tell, make me out to be the bad guy...

Oh well lets see what happens...I wont hold my breath.

The IO informs me the hearing is this Monday.

2-days to go...

Hopefully the nuisance calls will cease - I cant wait for it to be all over Inshllah.

I just found out the outcome.....the hearing was ADJOURNED as she had late representation.

So there you go - she managed to wangle her way out again.

Was the judge having a laugh!

The AIT what a joke!

My brother is a lawyer and he says he would never put me on the stand, as he believes I'll lose my cool and swear at her.

That wouldn't be a wise move really!

The hearing is set for the AIT in Manchester - would I contact this AIT or any of them?

I've also been informed the HOPO is only picked 24-hours before the hearing by the AIT in Manchester.

So could I meet him @ the hearing & give him an overview even if I decide against being a witness on his side?

Also would I have to go the nearest AIT to her which is in Manchester - 320 odd miles from where I live?

I've changed my mobile phone no. and I keep receiving calls from a private no.
This is really beginning to do my head in now - as only 10 people have my no. and the only place it's going to be is on the letters/evidence that would have been provided to her lawyer/solicitor to look over.

You'd think they would have blanked my personal details out, but obviously they haven't - just received another two calls whilst writing this blog!
This is getting beyond a joke!!!

Just a general question for any immigration specialists or lawyers.

How would you get the judge to adjourn the hearing - if you're client had arrived without a valid visa?
And had divorce being processed in Pakistan - and the appelant was arguing the divorce wasn't valid?

Would that give you enough to get her leave to stay?

Or would you advise her she needed to go back to the home country and re-apply for a visa?

As a side point on 10 nuisance calls today! :roll:

Hi all,

I spoke to the Home Office Presenting Officer (HOPO) yesterday.

He informed that if I was still receiving nuisance calls, to get the police to fax a copy of the report to the AIT & hisHOPO unit in Old Trafford.

He said the judge would not be looking @ just her visa status, but her reasons for coming back.

He said that they had forwarded the letters I had written to the AIT, by simply just photocopying them and giving them to her solicitor and they may well have not blanked my details out.

Just very angry as I'm still being harrassed, and the Immigration Officer had informed me it would be an open & shut case.

The date has now been reset for the 22-April 2008. :wink:

My wife is trying to obtain REFUGEE status.

Is that feasable? Considering she entered by deception on a visa spouse.

Hello,

As a lady she has a bit nore chances of success with that, although there must be QUITE some evidence to prove that her life is in real danger if she returns.

I wold say that her chances of success are slim, unless she gets legal aid=public funded lawyer and it goes on and on and on...AIT...High Court/Court of Appeal/House of Lords...European Courts.

It all depends how she is determined...

Hi Immigration Lawyer,

I wouldn't say she was in any danger from anyone, as all her family are there (bar her paternal uncle).

Also the town she lives in is Jhelum which is hardly a backward town, if anything it's quite upbeat.

Do the nuisance calls not account for anything?

The situation is, is that I've already changed my no. twice, I've changed my landline for the 1st time in 15years.

Also it' not me, just receiving these calls, it's my dad as well.

The point is that they want to try to bully me, and what they don't realise is that I don't "bully easy".

We don't get intimidated by people ringing up, it causes me stress but it doesn't scare me.

The more she calls, the worse it looks for her and her friends.

I don't know how the Asian community operates in Blackburn, but ringing up and acting like a kid doesn’t work.

They’ve got all my personal details address, Tel no, enough to commit identity fraud.

I know what SOME Asians are like – the criminal element is an angle I can’t afford to ignore.

Maybe it's her kismet/fate to live in the Uk.
