In UK on HSMP - status of our baby born in UK

In UK on HSMP - status of our baby born in UK

Hi,

I recently got my HSMP approval and am trying to figure out the consequences of moving to UK.

If we have a baby borned after moving to UK on HSMP, what status will our baby assume? Will the baby be a dependent on our HSMP visa or an ILR? What in particular to we need to do to get the baby the required status?


Any insight is much appreciated.

Baby will be depedant on your HSMP Visa....You will have to get the baby a ppt or include the baby in your passport. If the former is done then you will have to apply to HO to put a Visa in the baby's ppt. This will be done in-country.

Thank you Chess for the info.

When will the baby be eligible for ILR status? Can this be done independent of our HSMP->ILR sequence?

Also, what are the available ways for the baby to get naturalisation or citizenship down the road?

Are there any HO documents to cover the above issues?

Hello there,

Your baby will obtain your immigration status and your nationality all through.

If the baby is born in the UK , you will issue him/her a passport from your consulate in the UK.

You would then apply to the home office for his/her LTR based on your immigration status.

When you obtain your ILR, your child will automatically obtain his/her ILR; either with your application to ILR or with a separate application.

When you apply for British nationality, you would apply for your child as well.

If your child is born in the UK and you afterwards obtain an ILR you will be able to register your child as a UK citizen. If you obtain an ILR before your baby is born your child will automatically be a UK citizen by birth.

There is one other factor to be aware of - automatic citizenship for the baby if UK born after the parents have ILR or registration of the baby for citizenship where parents ILR is gained after UK birth requires that where the only person holding ILR is the father of the child he must be married to the mother of the child.
