ILR ELIGIBILITY for DLR

ILR ELIGIBILITY for DLR

Hello with due respect guys i need your help regarding my indefinite leave to remain application.

My wife was on asylum 5 year visa when i apply flrm application my application got rejected but was granted discretionary leave to remain ,because my wife was not british that time, on 13-feb-2012 for 3 years. I apply extention on time in feb-2015 and was granted visa until 10-dec-2015 because my visa was expiring at 10-dec-2015. She apply for her ilr in dec-2015 and my solicitor also apply my ilr saying that i can also apply. She got her ilr in march-2016 but i got my ilr rejected because i didnt complete 6 years on discretionary leave but was granted 3 years further extention on 10-may-2016 which expires on 10-may-2019. But i am planing to apply for my ilr in feb-2018 because my initial leave was granted in 13-feb-2012 and the 6 years period complete on 13-feb-2018( 13-02-2012 to 13-02-2018). I need your guys help to tell me if its the right decision or not because i am not sure weather the time taken by home office to grant me leave count toward these 6 years or not.

Thanking in Anticipation to every one for helping ne out.

Below is the short break down of my leave.

1. FlrM rejected but dlr granted on 12-02-2012 till 12-02-2015.
2. FlrO granted on 10-05-2015 till 10-12-2015.
3. Ilr rejected but extention granted 10-05-2016 till 10-05-2019.

Furthermore, my wife applied for her citizenship and has been granted she will attend her ceremony on 13-12-2017. If i can apply for my ilr in feb-2018. And if i get my ilr in feb2018 because i will gor for same day servive, will i be able to apply my citizenship straight away because my wife is british?.

Hi,

My understanding is, you can be eligible to apply for ILR no sooner than 28 days before (or within) completing 6 years of DL.

also, please read this link in regards to applying for BC. My understanding is once your wife becomes BC, and as long as you meet the residency requirement of 3 years, you may apply straight away. All valid leave of stay in the UK can count towards that requirement.

if wrong please correct me.

Yes, your first grant of DLR was on 12-02-2012, you would be eligible to apply for ILR once you have completed 6 years of DLR. You can apply 28 days before or within 28 days of completing 6 years of DLR.
