Previous marriage

Post by earthshine » Thu Dec 14, 2017 8:27 pm

I am a EEA national, been here for 8 years with permanent residence since 2014, previously married to a British citizen for 5 years but I have been divorced for the past two years. I am now applying for naturalisation. Do I need to declare my ex husband's details under s 1.38 of Form AN, even though I am not applying as a partner of a British citizen?

NO!

Just write "divorced" where asked.

I believe you also need to answer questions 1.38 to 1.44 as well.

I believe you should as it won't cost anything to, better be safe, there must be a reason it is required. I did declare mine.

I have read that but don't understand how 1.15 relates to not answering 1.38

If you are divorced, tick the appropriate block in 1.15 (if not currently married) and then complete the relevant details in 1.38. This has no effect or bearing on your application but you must answer all questions honestly in the form.

Yes, if your marriage was within the last 5 years.
