Switching from UK Tier 2 to Spouse Visa

Post by pred02 » Thu Dec 21, 2017 12:00 pm

Hi,

My partner and I are planning on getting a civil partnership. I am an UK (and EEA) citizen she is Canadian on Tier 2. We have been together for a bit over a year and living together in the UK for 6 months. She is looking to switch from Tier 2 after marriage as the employer is not doing too well and does not want to risk losing a job and having to leave the UK.

What will be required for her to get the dependent visa?

Thanks

Change to Spouse visa on form FLR(M) and meet all the requirements.

getting a civil partnership
Are you a same sex couple hence the civil partnership?

Then it is a normal marriage. You and your partner are required to attend an HO approved Registry office to give 28 days notice of your intention to marry. They inform HO and this notice period could be extended to 70 days before HO will give permission to marry. HO may interview each of you if they feel this is necessary.

Civil partnership is for same sex couples.
