HSMP extention into Tier 1

Hello all,

I am currently in the UK on HSMP. My leave to enter expires on 23 Oct 2008. What is the earliest I can apply for extention under the new Tier 1? I have look on the Border Agency website and the application forms & guidance notes but cannot find anything relating to this. I remember previously it used to be 28 days before the expiry of current leave to remain but does it still apply?

I want to travel in December this year and I want to make sure that I will get my passport back before the begining of December.

You can apply 4 weeks before our LTR expires. So you can send the application 21-22 September. The return of your passport depends the log at that time but I feel that there is enough time (two months) to hve your passports back. Alternatively you can send urgent treatment form.
