MN1 Guide:Section 3(1) application Children born abroad to parents who are applying for British citizenship

Post by ka06 » Sat Jan 06, 2018 12:25 pm

Dear members,

I have a couple of question on the eligibility for a child born in India( in 2016) to register as a British citizen from MN1 Guide. Please answer them. I would like to hear success stories from other members.

1) Is the child eligible if Father got ILR before the birth of the child and British citizenship through naturalization in 2017 and mother is got ILR in 2018?

2) The MN1 guide mentions that this should as part of "family application". Can I apply only MN1 application for the child if neither parent is applying for Citizenship?

3) Can I use the Nationality checking service at the local council?

Below is the extract from the MN1 Guide relevant to my case:
https://www.gov.uk/…/attachment_data/fi ... /MN1_Guide_…
Registration at the Home Secretary’s discretion – Section 3(1)
application
Children born abroad to parents who are applying for British citizenship

Where one or both parents are applying for British citizenship they may apply for one or more children who are not automatically British at birth (see “Automatic acquisition of British citizenship” above) to be registered as British citizens as part of a “family application”. Children in this category will be considered at the Home Secretary’s discretion and will usually be registered only if both the parents are granted or already hold British citizenship, or if one parent holds British citizenship and the other is settled in the UK.

Many thanks in advance,
Thanks
