MN1: children born abroad ILR and residency queries

Post by ka06 » Tue Jan 16, 2018 1:52 pm

Dear members,

Am a British Citizen and I have a couple of question on the eligibility for a child born on April 2016 in India and came to the UK as PBS dependent in February 2017 to register as a British citizen from MN1 Guide.

Below are the child details
Passport Details
Date of Birth
April 2016
Citizenship
India

PBS Dependent UK Visa details
Date of first Visa Stamping in India
Jan 2017
Date of Entry to UK
Feb 2017
Date of Visa Expiry
Feb 2018

1) Is the child eligible to apply to Register as British citizen using the MN1 form with her mother who got ILR and applying for Naturalisation in February 2018?

2) Is ILR mandatory for Child born abroad?

3) Are there any residency requirements for the child, is less than a Year in the UK a problem?

Below is the extract from the MN1 Guide relevant to my case:
https://www.gov.uk/…/attachment_data/fi ... /MN1_Guide_…
Registration at the Home Secretary’s discretion – Section 3(1)
application
Children born abroad to parents who are applying for British citizenship

Where one or both parents are applying for British citizenship they may apply for one or more children who are not automatically British at birth (see “Automatic acquisition of British citizenship” above) to be registered as British citizens as part of a “family application”. Children in this category will be considered at the Home Secretary’s discretion and will usually be registered only if both the parents are granted or already hold British citizenship, or if one parent holds British citizenship and the other is settled in the UK.

Many thanks in advance,
Thanks

See also guidance for more information on Section 3(1) applications. They expect child to have ILR, etc.
