I got my Visa Extension for change of employer under Tier 2. I have given the list of documents below which i have provided during my application.

1 Passport, Photos, Document Checklist are Mandatory (I don't have BRP card)
2 Certificate of Sponsorship print (Number was shown as invalid on the Visa website,i have taken confirmation
from the HR before proceeding) as supporting document
3 Offer Letter from the New Employer as supporting document
4 Utility bill as proof of Address.

my application was straight forward, so they have taken 1hr 30 min.

Visa is provided only for 2 Years, i thought they may provide for 3 Years.

Thank you

It depends on how long you have already held a Tier 2 visa.

i have initial Visa of 3 Years which is valid until April 2018.

i thought they may give 3 more years visa, so that if my ILR rejected in 2020 (completes my 5 years in UK), i can stay for 1 more year which makes total 6 years. Please correct me if am wrong.

Giving two years, could be an error, as you mentioned that you had the visa for nearly 3 years only. I think experts can comment on this. But how do you know the end date? Is it on the approval letter, since the BRP is not arrived yet?

Yes, it is on the approval letter and visa officer also mentioned the same that this will be on my BRP card as well. But i have not asked this question at the same time.

I think this is something to do with your end date. Not too sure though.

Your visa will not be issued for longer than the CoS dates. As the CoS had an end date of 1st June 2020, your visa cannot be issued for 3 years.

Re: Tier 2- Can i continue work with current employer ?

Post by vsan86 » Thu Feb 01, 2018 12:00 pm

Hi All,

I have recently applied for Tier 2 Visa (General) for change of employer on 26th January 2018 and Home Office approved my application on the same date. Issued approval letter with start date with new employer as 16th April 2018. I have received my BRP card recently, on the card date of issue is given as 26/01/2018.

Can you please let me know whether it is legal to work for the current employer until 15th April 2018 or do i need to stop working for the current employer and change date of joining with new employer. Recently i have given notice to my current employer.

this question is asked by my new employer to take legal advice on working with current employer. so am posting here before going for any legal advice.

Am sorry i dont know whether i need to ask this as a new query, so i posted in my existing related thread.

Thanks for your help.

Hi vsan86,

There is definitely an error of issuing you 2 years instead of 3 years (when combined with your initial 3 years is not more than 6 years).

To tell you my story, the caseworker handed me my visa which was 2 years instead of 3 years. I knew it was right so I got back to her to explain why I wasn't allowed to stay for 3 years as my initial visa was 3 years so I should have had 3 years. I know my total time is not over 6 years. The lady went back and probably had a chat with someone and it turned out that she misunderstood (maximum stay in tier 2 is 6 years, maximum length of tier 2 per application is 5 years).

I would suggest you contact Home Office. Otherwise, it might be difficult for your ILR and it will save you a hassle if you need to extend your tier 2 visa for another year!

The members CoS was only for just over 2 years so impossible to get a 3 year visa when the CoS end date is mid 2020.

Hi ideotea,

Thank you

it was my mistake, as i dont know about the COS and visa dates relation as suggested by CR001. i should have asked my employer COS for 3 years before applying Visa. And my employer is happy to sponsor for the ILR application in future, but anything may change by that time. i will be eligible for ILR in Feb Ending 2020 and my current Visa is valid until June 2020, so i dont think any problem for the ILR to apply.
