HSMP CASE- What after t hat

HSMP CASE- What after t hat

The recent announcement of the HSMP case being won in high court is a good news as it brings relief to a lot of HSMP migrants. But my question is waht after that?? I'm a bit confused on what to do now as there is a lot of confusion created. My case history is as follows:-

1- Case submitted to HSMP Tea- 18.10.2006
2- Date of HSMP approval letter- 21.11.2006
3- Date when EC was granted- 27.12.2006
4- Date of Arrival in UK 07.03.2007
5- Date I started my first job 23.07.2007
6- Date of expiry of Visa 27.12.2008

can any person guide me that if the home ministry doesn't appeal, then will I'll benefit & apply on the form on which only economic activity is required or do I need to apply on FLR(HSMP) version 04/2007 in which the same points based system is used where I need to score 75 points.

Your help will be highly appreciated.

the process hasn't been defined.. Also, it will depend on if HO chooses to appeal as an error in law, in which case they can drag it out further.. There is another topic on this forum where people are discussing impacts, you should check that out.

If the HO does choose to implement the ruling, then the process will take a few weeks at least, and they will indicate how to apply..

My query is that whether I'll get the advantage of "economic activity" or not as my case was submitted on 18.10.2006 but the HSMP Approval was issued on 21.11.2006. Later on EC was granted on 27.12.2006. I'm a bit confused. When my case was submitted, the criteria was to score 65 points which also includes the points of my wife as she is a doctor.

Can any person help me out? Moreover, can any person send me the FLR-HSMP form of the older version which doesn't require the applicant to score 65 or 75 points. Can anybody email me that? I'll be most helpful.

When you apply extension under the old rule (HSMP) the point is not relevant 65/75 whatever. The main criteria is economic activity so do not need to worry how many points you have got.

Keep in mind that HO has not declared yet whether to appeal or to accept the JR decision. So as other have said they can drag it out further using time delaying tactics.

I do not think you could legally use the old HSMP form for extension.
